I was told by a Nintendo Rep that Bayonetta is most likely definitely in the game already or will be via DLC. This is what he said when he was in last week. Kind of excited if this is true.

So has the DLC thing actually been confirmed? I heard rumors of it and DLC Characters already.

Honestly, playable Bayonetta makes sense. We already know that Kamiya has been contacted at one point or another by Sakurai to use his designs by the inclusion of Wonder-Red, so it's far from outlandish that Bayonetta would grace the game in some fashion.

SmashGaf quickly filled a little less than half of the football field. There were many students, and even some teachers were in too. I love the countdown gifs, but honestly, I can't get in the spirit. The way I see it, it's not 22 days, it's 42 days. For me, the only release date that really matters is the one that lets me actually play Smash, and that date is October 3rd. The Japanese release will be, for me, just another info dump, like a Smash Direct or E3. Don't get me wrong, that's still really cool, but I can't get too hyped for it when I know that the real deal is just three weeks later.

They can't confirm or deny anything like that, Nintendo would be on their ass immediately. At best you'll get a "the ESRB does not comment on rumors or speculation" response.
