I might be stretching data here but could the over 40 characters simply be referring to the starting roster? Based on this image:
There are 36 icons in this roster which we presume is the starting roster. Add the Miis that's 37 from the very start. (39 if you wanted to argue the Mii's as 3 separate characters)
Now add in the known alternate character models. Wii Fit Trainer Male, Villager Female, Robin Female. We now have 40.
Add the rumored Alph model for Olimar, or the obvious Daisy model for Peach, we are up to 42 playable characters from the start. This is over 40.
It would make sense because if I bought a game as a consumer but didn't realize there that the conditions of 40+ require unlocking them I might be upset as an average person if that was the selling point. Which would make the argument that 40+ vs 50+ referring to total characters in game moot.

Depends on if it's 'final build demo' or actual final build, like they do in some demo units (easier to put final game in than build a demo, but it might spoil stuff if someone sits at the demo unit all day and unlocks everything.).
