There is not one moment during that specific dialogue where she switches gears and changes the subject to anything else other than the being questioned about the song. This is a fact because those are her words recorded on video.

True, it's all about the expectation of privacy. This will lead to depositions of whether Swift knew she was on speaker. Anyway, I wouldn't bother with civil action. It would just keep this in the press longer and be a huge unnecessary legal bill. Do something like Drake did when he got into an argument with another artist, release a song that lowers the West family down a peg or two.
