Yep. Or lets not forget the myriads of fake Pokémon scans that come out every time a new game is in development, to the point where they look nearly identical to the real publications. These screenshots mean nothing and still leave a lot that need proving, regardless of their quality.

The prosecution is making a red herring. The original accusation here is that the defendant removed a feature found in previous games. The prosecution must prove that, as it's impossible for the defense to prove that they have not removed said feature at this point in time.

That trailer was trying to pass off as a new game, not one that's currently in development with media that we've already seen.
If the Palutena is a fake they would probably have to recreate the stage with perfect accuracy based off of a handful of screenshots, recreate with perfect accuracy the Mario model, and create from scratch a brand new Palutena model that matches the existing 3DS aesthetic.
I don't think that's necessarily less work at all than that dark blurry video. Prove me wrong.
They definitely aren't going to risk crushing expectations or implying that she's really in or not. They probably love this free advertising.
