82 Year Old Man Charged With Attempted Murder of Two Thieves (Mugshot Bonus)

WHEAT RIDGE, Colo. - Police arrested two men Friday in connection with the theft of a flatbed trailer belonging to an 82-year-old Wheat Ridge man, who fired shots at the suspects.

Damacio Torres-Ochoa, 32, and Alvaro Cardona-DeLoera, 28, both of Thornton face numerous charges including felony theft.

FOX31 News confirmed Friday that U.S. Immigration and Customs Enforcement had picked up Damacio Torres.

The ICE will transfer Torres-Ochoa's custody to the Jefferson County Jail where he will be held on a $100,000 bond.

Torres allegedly confessed that he and Alvaro Cardona stole the trailer from Robert Wallace's home in February.

Wallace said he fired two shots at the thieves, hitting one of them, as they tried to run him over while they sped away with his trailer.

The 82-year-old homeowner, who said he was defending his property and his life, is facing the possibility of spending the rest of his life in prison.

The Jefferson County DA is charging the homeowner with 12 felony counts, including four counts of attempted first degree murder.


Wallace did not want to talk about the case, but Friday told FOX31 News he has received letters and calls of support and wants to thank people.

"No matter how this whole thing turns out, at least I have made a host of new friends," said Wallace.

The affidavits for the arrests have been sealed until further notice, authorities said.

Torres-Ochoa's and Cardona-DeLoera's court date is scheduled for July 12.

I guess the rub is that he shot at them while they were outside his home, not inside his home. But If it was his property, I don't see a difference, especially since they tried to run him over.

Also he shot at two people and gets 4 attempted murder charges?!?!?!?!?!

You can't shoot at thieves on your property while they try to run over you? :lol If I had a rifle, I would have done the same damn thing. Would be horrible if the guy has to spend his last few years in jail over something like this, while the good-for-nothing thieves may very well be out in no time.
 
Is the law system insane or something? If what the man says happened is what happened then he should be paid like $1 million from the state for them even trying to put him in jail.

One of the very few times that I hope the entire jury is composed entirely of conservatives.
 
While I have little-to-no problem with people killing thieves who are attempting to burgle their homes (the exception being something like an unarmed thief surrendering and being shot anyway), I don't really cotton to people shooting guns after them in the middle of the night. Even trained cops can be notoriously bad shots in the best of circumstances. And I absolutely hate the "tried to run him over" scenario. That means he probably jumped in front of the car. Life is not a movie. They aren't going to get very far with your flatbed trailer if you call the cops immediately.

LOL. This is the only valid situation a person can have for owning or wanting to own a gun.

My friends and I witnessed a Dennys employee's car get jacked(was his fault for giving the keys to random strangers anyway) while we were eating at the diner and by the time the cops showed up 5-10 mins later, the thieves were long gone.

We went back to that Dennys a few months later and asked the guy what happened to his car, he says they found it 2 weeks later gutted on the far side of East LA(about 20 miles from the diner).

edit: though a flatbed trailer would be more obvious to the cops as opposed to a car so you're right :p

As for the OP, sucks for that old man. Burglary is a traumatizing experience(happened to me while I was home once) so I dont blame him for trying to defend himself.

Gotta love the judiciary system =/

I can understand two attempted murder attempts, but four? How did they come to that conclusion. I don't see why the old man decided to shoot those men though. A trailer can't get very far away in that given amount of time, and he could have easily called the police.

For everybody whining about how the victim here is getting punished, the man never told the police he felt his life was in danger and initially denied shooting at anybody. Plus, the bullet hole was in the passenger window which hardly fits with the "they were trying to run me over" explanation.

they tried to steal his home.. he should have every right to shoot them

Sounds like they are spinning it that he fired twice at BOTH suspects, making it 4 "attempts."

Go criminal justice system!

While I am not pro violence and don't believe in gun use, this seems to be the exact circumstances that Americans are ALLOWED to own guns FOR.
 
Self defense and castle doctrine does not cover stuff outside of your actual house. Going outside and confronting thieves with a gun is a no no even in most states with very liberal gun control laws.

Yeah this is true unfortunately. However, it doesnt really state if he was still on his property or not. Also, its tough to see if he was justified because of two factors:

1) They were escaping which does not justify legal deadly force

2) They tried to run him over, which DOES justify legal deadly force

I'm going more with number 2, especially since open carry is allowed in Colorado(except for maybe Denver, but I'm not sure about that). Now if he shot as they were coming towards him, he was totally within his right. If they were moving away from him and then he shot at them, that doesnt justify it unless they were attempting to run more people over.

Needs more information, but it seems like from the article he was within his right.

Well the problem is with self defense, your basically allowed to stand your ground, and to protect your home, but not to confront someone. Since the shooter left his home with his weapon and basically confronted the thieves with a weapon, he can be charged with various things.

It's happened before as they will argue that it was a simple burglary, but that the victim confronted the thieves with a gun and forced the situation to escalate.

When you take your concealed permits they usually go into this as to prevent people from going rambo and getting themselves in trouble. Like someone is in your driveway stealing your car, you are not supposed to run out with your gun and try to stop them as initially your life was not in danger and a weapon is not to be used as a theft deterrent, it's for self defense.

Even in an open carry state your usually not allowed to confront an individual in such a situation, and self defense still remains on the idea of standing your ground.

Indeed. After reading that police report it seems to be looking grim for the guy.
