A man with a history of posing as a modeling agent in order to satisfy his foot fetish was arrested Wednesday on charges of battery, exposure of sexual organs and false imprisonment, records show.
The latest charges against John Joseph Capio, 35, stem from an incident the night of April 6 outside the Lit Hookah bar off University Boulevard near the University of Central Florida's main campus.
A woman at the bar said she was approached by a man, later identified as Capio, who "started talking to her about how pretty she was and that he could make her a lot of money as foot model."
He asked her to follow him to his car so he could get a business card. "Trying not to be impolite," the woman followed, an incident report states, but she soon became suspicious and explained she needed to leave.
Capio then grabbed her arm and pulled her to his car, the woman told deputies. Once there, he sat in the front seat, "grabbed her leg and... pulled down his shorts," exposing himself, the report states.
Capio then touched his genitals with the woman's foot, the report says. She struggled, broke free and fled. A friend flagged down an off-duty deputy for help just after midnight, but by then Capio had left he area.
Though the victim couldn't identify her attacker, investigators quickly matched her description of the incident to Capio, court documents state. He was accused of two similar attacks in the same area about two years earlier.
About 9:30 a.m. Nov. 17, 2010, authorities say Capio approached a woman outside a Winn-Dixie store, also on University Boulevard, told her he worked for a modeling agency "and asked whether [she] wore a size six."
Capio "then grabbed [the woman's] foot and licked the sole of her foot," court documents state.
About 10:30 a.m. the same day, Capio approached another woman at an apartment complex on Pershing Point Place, court records state. He grabbed that woman's foot and "and attempted to place her foot inside his mouth."
Capio was convicted in both of the November 2010 attacks and sentenced to nine months in the Orange County Jail, as well as probation. He later was arrested for violating his probation and was sentenced to 18 days time served.
Records show a prior arrest and conviction from 2001 on charges of lewd behavior and exposure of sexual organs. The facts of that case weren't available Thursday. Capio has also been arrested on burglary and drug charges before.
An affidavit shows a warrant was issued last month in the Lit Hookah incident after detectives matched Capio's DNA to samples taken from the victim's foot and calf. He was arrested about 10 p.m. Wednesday, and remains jailed.
