It is free for people with XBL. The retail version (which sold 196k copies last month) won't be free

Well, I guess if you don't have xbox live and are just playing Lan parties, but in that instance at least one of the people there would have the disc.. Its useless for it to be included, especially since the only other use is Xbox Live.
