I don't think there's anything in the ESRB manual that says hidden content that is disabled must be disclosed when submitting the game for rating? I think this investigation might end up hurting the ESRB much more than Rockstar. Rockstar did what it had to do, responsible or not that not the issue, they have acted within the guidelines.
Like I already said. They're probably not investigating because of deceiving the ESRB.

If Rockstar deceived the ESRB with an ulterior motive of subsequently deceiving retailers for cash, uh oh.
 
Rockstar deceived a voluntary scheme? errr.... Big deal?
How much clout can a scheme have if the publisher has to subscribe to it voluntarily in the first place?

Surely more companies will just chose to opt out?

Am i missing something?

I don't think there's any if about it. It's just interesting to see how the responsibility will be apportioned between Take Two and Rockstar.

Yes. Although the scheme is voluntary, businesses such as retailers use it. For example Walmart have a policy to not carry AO games. By deceiving the ESRB, Rockstar have basically defrauded Walmart. It's also not just about the money they made through the games sales. Walmart have cultivated an image as a family friendly retailer and this kind of controversy hurts that. So yeah, this is some serious stuff. Even if the lawmakers don't succed in hanging Rockstar, retailers do have the option of refusing to do business with Rockstar anymore. We have lots of theory about how the controversy may increase GTA sales, Walmart and co may decide they don't want any of that even if the next GTA is rated M.
 
I didn't read the thread so I don't know if this has been asked before, but what effect does this have on GTA: Liberty City Stories?
