Release a new game for the two previous generation consoles - technically possible?

I have asked a similar question on another retroforum too.
I was wondering if crude technically you think would be possible to release today a new game for some not much old consoles
like PS3/Xbox360 or PS2/ogXbox/Gamecube, if not some handhelds of the same generations?

Would Nintendo, Sony or Microsoft give a green flag? Other issues?
 
If the console has any sort of copy protection they might probably take it down via DMCA for breaking the encryption. For older consoles with basic or no protection I guess you shouldn't have problems.
 
It would need to be an unofficial / unauthorized release.

Cause Sony/MS aren't going to cert approve games for 2+ generations old consoles.
 
There are a lot of indie games coming out for Neo-Geo, Genesis, SNES, etc.

But once you get into that PS3 era, you're dealing with copy protection, encryption keys, approvals, etc., and the hardware makers just aren't approving games for them anymore and haven't for a long time. I think PS2/GameCube is a hard stop, some games have come out for that era.

i'm the lone here to think that this is a little shame?
i mean, i think there still are a lot of those console in the houses, it would be imo interesting to see something popping out, even if rarely
