It's not illegal, but assuming you realized the mistake in anything resembling a prompt fashion, it is unethical.

I don't understand the line you're trying to draw here. You concede that it might be unethical, but you don't want to be on the hook for potentially breaking the law even though there's no chance that you will be caught at this point.
