U.S. Supreme Court Rules Unanimously for Microsoft in Class-Action Fight

The U.S. Supreme Court on Monday ruled unanimously in favor of Microsoft Corp against a lawsuit filed by customers who said the company's Xbox 360 console destroyed game discs. The court found that the customers who sued Microsoft did not have a right to appeal immediately after a trial judge rejected their case as a class action. Procedure dictates that class-action status cannot be obtained until a trial judge has made a final decision. The consumers said they met the requirement because they voluntarily dropped their cases. Writing for the court, however, Justice Ruth Bader Ginsburg said the action was not allowed because the voluntary dismissal of a lawsuit is not a final decision and cannot be appealed.

Are they alleging it scratched discs? Or that the RPM was too high?

The disc drive lacked a standard $0.50 piece of rubber, which would of prevented damage. Microsoft claims damage is from users moving the console while the disc was still spinning.

Eh. I HAVE actually had a 360 that murdered discs. It rendered 4 copies of LO unplayable and literally split a Gears disc without ever being moved. Figured it was a one off dodgy unit.
 
I remember that happening to my disks. I had to use those D-skin "disk condoms" which also sometimes made it hard for the disks to be read.

yep i lost a few games due to this shit. MS made some really stupid design decisions with the 360, sheesh

The disk scratching would also happen if you moved it from vertical to horizontal while the disc was spinning which is the user error that Microsoft talked about being a possible cause. I worked at Blockbuster in this era, we saw a lot of these damaged discs. Its a shame Microsoft isn't being brought to task for a design flaw. .4% sounds waaaaay to low.

My Halo 4 disc got destroyed that way, but it was because there was a piece of plastic flash on the top of the disc tray.

I wasn't aware the SC even handled cases like this. Seems like a waste of their time.

People who accidentally orient the console from side to flat during use, or people who are removing their console to take it somewhere or position it better and accidentally don't turn it off.

I totally scratched a MW2 disc that way.

They're selective over what case they'll hear, but this one was about a procedural issue involving federal law, and SCOTUS unanimously disagreed with the 9th Circuit's ruling. The actual content of the dispute is irrelevant here.

OH, now I get it. This overturned the lower court.
9th circuit fucked that up to get a unanimous overturn.
