After looking at the All-Star menu, I really don't think they'd leave Solid Snake off a menu celebrating the cross-over characters if he were included in the game, especially when they did that for him in Brawl and are doing it again for Sonic the Hedgehog. If there are still unlockable characters, I don't think he's one of them.
