The PS Blog's store update article has over 600 comments and not one person from Sony has responded.

Seems real shady to me. They're doing a horrible of handling this situation. I'm getting flashbacks to that hacking scandal a few years back.

I don't think there's any shadiness going on. I just think is Sony being a bit disorganized.

I still have hope they will release the PS+ version tonight, and people will just forget this whole issue.

I think they're pretty clear that the package of products in the service can change at any time at their discretion (and they have modified the terms of the Instant Game Collection twice in the past). Where do you see contractual delivery of the IGC?

First of all, I had read your linked passage and nothing in it allows Sony to not deliver any promised games, rather it covers outages and lapsed subs.

In this case, PS+ is marketed as including the IGC of the current month at least. Here's some evidence from their own websites marketing the subscription. In particular, the third image is taken from the legal section of their site explaining what you get with PS+, and would be strong evidence in court of Sony's promises with this service. They are selling monthly access to games as part of the service, of this there can be no doubt.

EU Directives state that you must deliver what you promise to consumers, and that contractual terms negating the core of the contract's real commercial value are invalid. I know that the directive regarding goods is 99/44/EC, and I believe the same Directive was updated to apply to services. I'm not going to get out my books (and I'm no expert in this area), but I know the same laws apply to services either way. Crucially, any contractual terms which negate any rights created by the Directive are voidable by the consumer. Also crucially, minor deviations in what is delivered and what is promised aren't covered by the Directive. That alone would cover any complaints regarding this delay, so Sony's cool in this instance.

There is also a prohibition on Unfair Commercial Practices and Misleading Commercial Practices stemming from this Directive and other associated legislation in most EU jurisdictions, in Ireland that would be the Consumer Protection Act 2007. Sony's actions in withholding the free games (if they were to do so - I'm not talking about this delay) would fall foul of this act in multiple ways.

In general, the courts will look to the commercial reality of a deal when looking at consumer protection issues and the reality of this deal is that the games are either the major reason to sign up for PS+ or A major reason, and are advertised as such.

I could get my books out and go into proper detail, but it's 4am over here and I'm probably about to go to bed. Anyway, there is no honest way to say that the games are an unrelated 'free' bonus to PS+ membership. They are marketed as an integral part of it, and consumers in Europe would certainly be protected by law if Sony was to fail to deliver them without due warning / opportunity to cancel subs etc.

Of course, in this case we're dealing with US law, and as I said, I don't know the terms and I don't know the law. But in Europe, your original point regarding the games not being part of the service as sold would be simply incorrect legally.

Well I'm talking about the lack communication. How hard is it to reply to the blog comments saying "we're aware and are working on it"?

The lack of communication is similar to what happened with the hacks.
 
Obviously Sony is following the 1st two rules about DRIVECLUB.

They are obviously in a panic room discussing what to do with the PS+ version since the mixed reviews have been controversial on both GAF and many social networks. No surprise if they delay the game, it would be another curious case of a publisher not delivering on promises. We wanted the game yesterday on the seven of October but since we don't know when its hitting, is just a gone gift for Plus users.
 
Just got off the phone wtih Gamestop HQ, they acted like they had no idea what I was talking about. Seriously? So I called Thrustmaster and they said they couldn't help me either. WTF they make the official wheel for fucks sake. These companies are so incopatent...someone give me another number to call.

At least it's acknowledgement there's A problem rather than "Plus Edition? I don't know what you're talking about" or pure silence. There's probably too much bureaucracy BS to go through to get a full answer ASAP, though "servers need to get patched up before we throw THAT burden on them" may be enough really.

This is shaping up to be another train wreck of a release. Already decided not to buy the retail. I am gambling on the Plus release, and hope it'll come tomorrow in EU. If not, then fuck this game.

As much as I love the PS4, it seems to be a long wait for something truly special to arrive. The best games of this year are shaping up to be TLoU and GTA V. For next year I can already feel The Order is not going to set the world on fire too.

I still think we're getting fucked in the ass with this glorified demo. And they ain't using any spit either.

Some people keep saying this, but aside from a few obviously joke posts about selling all your Sony gear, what posts are 'overreacting'?

People have a right to be mad. They were promised a free version of a game over a year ago and were told they would have the game at launch. Also the servers are down for people who did buy it and we're now PAYING for PS plus which was supposed to help avoid situations like this.

I don't think anyone thinks it's a conspiracy, people just think this shit is unacceptable.

I've had a feeling this will be Evo's last game for a couple of months now. I don't see Sony supporting two racing studios especially with the way Driveclub must be selling (complete speculation on my part).

Communication is clearly not their strong suit.
Never has been, never will be.
Even when PSN was compromised and credit card numbers were exposed, they remained silent for hours.
They're a bunch of shady motherfuckers.

We bought their fancy new toy because it was clearly better than the alternative. But they also sold us a bunch of snake oil regarding everything else about said toy back in February of last year. Let's not forget that. Good thing the PS4 is profitable and selling well globally or they'd probably treat the rest of their gaming division like they do the Vita and do away with the whole blasted thing.

It's a real shame too... I love my Vita.
 
All of this over what will probably amount to a single day of not getting a trimmed down version of a single game. Hoooooly shit, go play something else while you wait and relieve your stress levels as some of the comments in here seem REALLY unhealthy.

I'm almost positive its their last game. Conversely, who'd want to employ a team that delayed a launch game, only to get the same scores it would have received last year? Everybody lost.
 
I'm sure it's been brought up already, but I just about guarantee they're holding this back until they get the server problems fixed in the full game.

While the free version will prove to people that the game is purdy and handles well, all of the CLUB stuff [a big focus of the game] being down could kill some sales.

Not to mention throwing thousands more users at the servers will just fuel this server fire!
 
There's really no point having the game while the servers are down. I bought it and stopped playing it until they're up because the online component is a huge part of the game. When the servers are back up if you still don't have the game go to town, but honestly you don't want the game as it is right now.

This is true too. I stopped as well. None of my fame (XP) going towards my club killed my buzz. Loving the game otherwise.
