So, once the BC update happened and was reflected on my Xbox One digital library page of ready to install games, I was quite satisfied, set many to download, but noticed I was missing one.
I didn't have Wolfenstein 3D, had like two dozen other Xbox 360 games show up on my digital library on my Xbox One, but not Wolfenstein 3D as I should of had. I was certain I had it on my Xbox 360. Looked at my achievements definitely have them for Wolfenstein 3D from as late as 2010, Wikipedia says it was released on XBLA in 2009.
Anyhow, checked Xbox.com's listing to see if it showed I owned it there, it didn't, but then I noticed it's listing date was 5/31/2013, 4 years later than when it really came out.
What happened from the looks of it is that Activision originally published it on the XBLA store back in 2009 along with the release of the Return to Castle Wolfenstein sequel, and Bethesda back in 2013 probably with the release of Wolfenstein New Order.
So, from the looks of it, they de-listed and re-listed the game, but they're not honoring the rights of those who purchased it back when Activision published it. I called the 1-800-4MY-XBOX and after explaining this to the moron on the other end for what seemed like forever who was like "oh I see you purchased Wolf Among Us; is that what you're talking about?... oh, Wolfenstein Old Blood, is that it?... have you tried unplugging your Xbox..." I just asked to escalate it. The supervisor realized the error was on their end and offered to credit my account $7 to make up for it so I could re-purchase it and that was good. Don't like I had to spend about 90 minutes on the phone with two disconnects to get it resolved but I'm satisfied with the resolution.
Still, anybody else that bought Wolfenstein 3D when Activision published it won't be able to get the current Bethesda re-listing without purchasing it again, or escalating the issue at MS... $5, might be worth not bothering talking to an MS phone rep. Maybe MS will fix this but I highly doubt it. They have de-list and re-list movies before but done nothing to resolve issues with those that have purchased them. Maybe I just got lucky here with the supervisor's discretion.
