If it were just about anyone else, I would be like WTF, but it's Scalia. It's been made clear over the years that he just does not give a fuck. He's out, and he's proud about his bigoted opinions.

Mismatch theory has...at best, mixed results on whether it's right or not - I'm not sure I'd be comfortable going down that road without firmer results that mismatch theory was more legitimate.

I didn't realize Kagan has to recuse herself because she was involved in the case itself at some point. It basically comes down to Kennedy + someone switching sides.
 
Remember guys, who you vote for for President doesn't matter. parties are the same. SCOTUS Justices are the same. Just vote GOP if you "don't want another Clinton" It's not like it'll lead to more Scalias on the court or anything.

Ironically Scalia has a history of refusing to recuse himself for conflicts, and there's no meaningful instrument to force him too.

The Supreme Court is a disastrously arcane instrument in a lot of ways. There HAS to be a better way of implementing its role of checks and balances. As it exists now, and not just because of its current makeup, it creates an imbalanced star chamber.

Politics threads on Gaf are amazingly full of this shit. These are the top three dumb shitty things I see daily:

1. I don't agree with everything Trump says but he tells it straight and we need a change.
2. The country is about to turn into the UK from V For Vendetta, perhaps tomorrow.

The most popular GOP candidate just recently proposed a mandatory religious registry to track individuals and restricting people of Arab decsent into the country.

Nazi Germany seems like the end goal here.

But Trump is a demagogue and a lot of people seem to be ok with destroying the constitution and everything else that makes us free. Do you think they will stop there if they get a chance?

I would have agreed with you a few months ago that he was a joke, but now it is getting scary. At least to me.

And I hope to Tebow that I am entirely wrong and that I am overreacting. But if there was anything that we should overreact to, in my opinion, it would be the path Trump seems to be taking us down.
 
Yeah, I can't really comment on what is going on here since it appears to be an out of context quote from a transcript of a court hearing. I'm too tired right now to look up the full transcript so I'm not going to pass quick judgement on what he said.

EDIT:

I didn't read the full transcript but just a little bit before Scalia's comments and after and I'm not really seeing a problem. Scalia is just asking questions like he's supposed to do during hearings, especially ones brought up by opposing counsel in their briefs.

Trump is crazy but the US is not moving to Nazi Germany come on. The whole republican platform is basically a campaign of fear, why do you want to mimick that?

That same thing was being said in the 60s (fascist, Nazi comparisons), when conservatism was just getting off the ground as a movement. Back then conservatives won on 'law and order' during the race riots. We were probably concerned that another race riot would bring about a fascist state in the US.

I don't see how Trump is exceptional in this regard.

The sitting commander-in-chief states he has the right to murder an innocent American citizen without due process. And brags that he's good at murdering people.

The president before him signed legislation while stating he hoped the court struck it down as unconstitutional.

Together they've seen a massive buildup of a national security state apparatus of historic size.

That's just three data points.

And yet. Despite that, despite the institutionalized unconstitutional warfare on the lower classes via prohibition, despite everything the NSA is doing, and all the torture and black sites and so on.

And yet, in many ways, we're freer than ever. Our capabilities continue to outpace the capabilities of the state. And that's been the story since the collapse of the Soviet Union really. Even in places like Somalia.

Real fascism, not our soft fascism, is an entirely different beast from all of that.
 
Affirmative Action is real lightning rod topic. I don't mean to offend anyone but I can see the logic on both sides of the argument. Tough topic for me to decide on.

As for Scalia, yep he's a hard-core conservative all right. I would expect nothing less coming from him.

I'm still waiting for the day that Clarence Thomas speaks up in court.
