Libel is illegal in America. No publication can print whatever they want. Trump friends and the NE are willing to lose millions in court? Especially since Cruz is running for President. The damages would be through the roof.

For the same reason Hillary is not willing to sue NE for making up stories about her having brain cancer or some such. You dont want those talking points to gain any traction in media even if they are false, because they will linger in the minds of voters.

The same reason why Bush campaign was conjuring up this idea back in the day that McCain might have a black child (outside marriage). They would go around asking voters if that possibility would change their perception of him. This is most likely absolute garbage and the people behind it know that Cruz doesnt want to spend any energy responding to it.
