Nintendo Goes DMCA on Switch Emulation

Simple!
Put hardware inside the dock that makes it faster and more efficient. We have thunderbolt now, so id assume nintendo could put a GPU the power of a 1050ti in the dock. add more memory, and a better cooling solution. Sell it for 100-200 dollars as an accessory, or as a bundle with the OLED switch that bumps the price up to 450/500. TOTK runs at 60fps at 1080p now, everyone's happy. People get their "pro" model (or rather, accessory) and Nintendo doesn't even need to make a whole new fucking system with improved specs in order to do so.

Literally a concept i'd thought up for YEARS now.
And then the power difference between docked and undocked modes becomes abysmal.
 
Please tell me how pirating modern day accessible titles is a reasonable excuse for the Switch, where it's titles are entirely accessible just like PS5 or XSX? They aren't hiding them, they are available right there in plain sight.

Also I'd love to know what your potential solution would have been to produce a better-performing piece of hardware at an affordable manufacturing cost that meets the design standards of the Switch? You have seen the price and performance of the Steam Deck, yes? Have you noted it's release date, and that it feasibly would not have been possible in 2017?

You can make all the excuses you want about the hardware and the absurd accessibility for modern games, but the point is there are people who use the tools for pirating. In this case, anyone currently playing TotK is pirating the software, no matter your stupid pre-order status. Because surprise surprise, you don't have the game yet, however are somehow justified in playing it early because "it will have shit FPS anyway."
I never argued it was reasonable. You can get upset and yell at people who are pirating Switch games all you want. Won't stop them. I am just telling you why people are doing it more for the Switch than for other platforms. Nintendo made a trash piece of hardware that cannot run their games at decent framerates or resolutions for 2017 standards. Nintendo made the poor decision of making a hybrid console. Sure, people love playing their games on the go, but I guarantee you if they made a dedicated home console with better specs for the same price, it would sell way more. Why? Because people don't want to play their games at trash resolutions and framerates.

You think the casual tech illiterate consumer would bother learning how to pirate Switch games? Most of the people in the emulation scene are technically competent internet users who have beefy PCs, which probably means they are gaming enthusiasts who like higher fps and resolutions for their games. What a surprise that a lot of them resort to emulation instead of using Nintendo's garage tier hardware!

**What technological measures do you have in place and how do they effectively control access to your copyrighted material?**

Nintendo embeds TPMs in both the Nintendo Switch console and video game files. Nintendo's TPMs include, but are not limited to, the encryption of video game files using certain proprietary cryptographic keys, such as those referred to as prod.keys. These TPMs, among other things, prevent users from unlawfully accessing and copying Nintendo Switch games. Specifically, Nintendo Switch games cannot be accessed or played on the Nintendo Switch console until the game is verified and decrypted using Nintendo's cryptographic keys. In their ordinary course of operation, the TPMs require the application of information and a process (as described above), with the authority of Nintendo, to gain access to Nintendo's copyrighted works, and thus effectively control access to and copying of Nintendo's copyrighted works.

**How is the accused project designed to circumvent your technological protection measures?**

The reported repositories offer, link to, or otherwise provide access to Nintendo Switch emulators, including but not limited to Citron, Eden, Kenji-NX, MeloNX, Pine, Pomelo, Ryubing, Ryujinx, Skyline, Sudachi, Sumi, Suyu, and Yuzu. Nintendo Switch emulators are primarily designed to play Nintendo Switch games. Specifically, these Nintendo Switch emulators illegally circumvent Nintendo's TPMs and run illegal copies of Nintendo Switch games. Nintendo Switch games are encrypted using proprietary cryptographic keys (prod.keys) which protect against unauthorized access to and copying of the copyrighted games. During operation, these emulators necessarily use unauthorized copies of these cryptographic keys to decrypt unauthorized copies of Nintendo Switch games, or ROMs, at or immediately before runtime without Nintendo's authorization. Thus, they are primarily designed to and unlawfully "circumvent a technological measure that effectively controls access to a work protected under" the DMCA, and distribution of these emulators constitutes unlawful trafficking in technology that is "primarily designed or produced for the purpose of circumventing a technological measure that effectively controls access" to copyrighted works. 17 U.S.C. § 1201(a)(1) and (2). The "hydra" comments are once again suffering. It's a goddamn miracle Eden exists, considering most capable Switch emulation developers are gone since the entire Yuzu/Ryujinx bullshit. Also stop using GitHub for emulation. We know Nintendo doesn't give a shit and just sends out DMCA notices and starts lawsuits nobody can pay for except they themselves. And might as well tack on that Discord, or any hosted/managed service in general, is a highway to trouble. It's all fun and games until Nintendo decides enough is enough.
 
They should really do something with DMCA law but as the whole law was passed solely due to corporations lobbying for it I do t think anything will change. Having said that it would be better to host it in the EU, block US IPs and just count on others to distribute it. Problem solved, Nintendo can't do jack shit.

It's fine if you say "fuck them kids, Nintendo take my money", but at least be honest about it. Also, the "stealing part" is linked to the "pirated copies are lost sales" part, which has been proven 2 decades ago to be a false narrative.

Emulation is not illegal, and everyone who went to court against emulation lost.
What Nintendo is doing is legal bullying, they know these developers don't have the money to sustain a lawsuit.

None of the Ryu/Yuzu forks have had any real fixes since the mains were stopped working on. It's mostly just UI improvements. If a game didn't work with Ryu/Yuzu, it probably still won't.

Yuzu never went to trial, they reached a settlement with Nintendo.

It wasn't the emulation itself, it was because they used encrypted Nintendo keys. Emulators usually reverse engineer these keys.
What was most impactful was that Yuzu was making money from it, they used Patreon to bring improvements to premium users.

Sega v. Accolade, Sony v. Connectix Corporation, and Sony v. Bleem: all of these companies lost, and emulation was deemed legal as long as reverse engineering was used without using anything from the original (clean room).

Aside from that, emulation is something used by default in the software industry, including large companies, especially when testing other architectures is necessary, like ARM to x86.

If they are going at it again then they must have caught wind that a Switch 2 emulator is very close for prime time.

You can't have a Switch 2 emulator without the Switch 2 being compromised. There aren't even dumped unencrypted games still.

They're not in the wrong tho, that's the point. These are emulators based on their technology, which are still commercially relevant in the market. Whether those are technologies 100% under Nintendo's ownership or under license from other companies (i.e Nvidia), doesn't make a difference. It effectively means the same thing.

Frankly I'm a bit surprised Microsoft haven't faced a lawsuit over this type of stuff yet. Yes "PC" is an open platform but 99% of these emulators are developed on a proprietary OS singularly owned by Microsoft Corp, and they benefit in sales of that OS based on implied grey area markets like emulation of game consoles still commercially available on the market. So in a roundabout way, they financially benefit by enabling piracy of hardware and software of competing games platforms, even if it is an unofficial benefit.

As the owners of Windows & its kernel, nothing's really stopping Microsoft from curbing on that type of stuff at the root level outside of there not having been a precedent set by other corporations, in part because no one's brought up a case. But I'd argue the components are in place for such litigation and has been for years.

Emulation, when it's actually rooted in preservation of data being completely lost to time, is 100% okay. It's why things like Internet Archives has universal support from everyone but certain corporations (for the usual greed-driven reasons). It's why certain emulation spots that focus on very-much-dead consoles/computers/arcade systems and games that are effectively abandonware or not actively sold by a publisher (and haven't been for decades) is generally cool with me. Being able to access ROMs of arcade games either impossible to find out IRL in working order, or costing several thousands of dollars to buy from limited remaining stock to play legally, is generally fine IMHO.

Unfortunately, a lot of folks in the emulation space are mainly in it to get otherwise easily (and usually fairly, in terms of price, if you know where to look or wait for sales) accessible games for free, and that has sadly created a vector for corporations to more easily come after emulators. The fact modern consoles are increasingly backwards-compatible does present a unique challenge to the usual "wait until the old system's not commercially relevant" argument, because if you're backwards-compatible four gens deep, the old system will always retain some level of commercial relevance. I get that.

In such cases, I'd at least argue for finding ways to jailbreak the official system first and introduce new features to the owners there, ahead of making emulators for a completely different platform and OS. At least for a while.
 
It's heartening to see all this disgust toward nintendo, but if we go right back to sucking their big hairy italian plumber dick the next day does it really matter? Nintendo has been known to be an asshole corpo for decades, even by it's own fans, but then those same detractors come around and buy everything nintendo and even go back to fanboying for them on the internet. Look guys, just dump them. Say 'fuck nintendo' sure, but also keep that at the back of your head, try to hold on to it, otherwise all you're doing by saying 'fuck nintendo' is giving them more mind share, because you'll forget the 'fuck' part and only remember their brand name.

Here's a small anecdote.

I am an emulation enthusiast. I also buy a lot of games. All my life (since the late 80's) i spend most of my money on video games and i still do. My favorite console was the N64, i had one with plenty of games. So most of emulation i did was for that system.

N64 emulation used to be really bad for the longest time and i struggled with it in the mid 2000s but when Nintendo released the Wii VC (on the original Wii) and a bunch of N64 games, i was delighted.

So i bought all of the N64 Wii VC games in one go. Despite having bought most of them already in cartridge form before and despite being able to play them for free on PC emulators later on.

The result? For my money and dedication, Nintendo sold me a bunch of PAL roms. PAL!. That's 50hz and black borders for you, in 2007!

You know how we used to call the PAL roms in the emulation community? "junk roms" along with other bad dumps or overdumps. And not only that, later on we all saw how bad many other European releases were on their services. Remember the Super Metroid fiasco? And even the US folk didn't fare better, on WiiU for instance you still had washed out colors and bad input lag. You also had censorship and other changes in classic games.

So tell me, why should i feel bad for a company i always supported and i still want to support and give them all my money, but all they do is making sure i get the worst experience possible?

For me, PC homebrew emulation has to do with ensuring that you get the best experience possible out of a game. It has nothing to do with stealing, in this case at least.

Btw its the exact opposite that happened in the legal world. Apple (yes, there are very well known precedents) was forced to open iOS for alternative third party apps as it was ruled the company having this kind of control over the system stiffled the market. Google tried to do the same thing with android but ended up giving up, probably fearing similar litigation.

Companies like microsoft would love to do nothing more than what you described, big techs love a walled garden. They don't because they know there'll be user and potentially legal backlash

Eh, no? The idea is always to extract device BIOS and keys of the games and devices you legally own. Emulation is not using any proprietary tech, if it was doing so I will argue they have a right to take it down.

There will be a better argument in the future when if PS7 is still rocking x86 or has some great translation layer, it can play back multiple generations. Right now they can only do 1, so they're still weaker than the fatty launch PS3.

It's kind of a losing battle though, all these companies are being pushed and incentivized to open things up. Just to be able to reach more people through ports, remasters with lowered cost using AI upscaled textures get double-dip money + new customers, and now you can create recomp games using more automated tools running roms people can make.

Nintendo is still the worst though. Discontinued servers for virtual console games, emulation is this pittance amount attached to a sub-service where games have left it, and using emulation tools they didn't make in their own games at their museum.

Emulators so far are not used to pirate a video game. Piracy is illegaly distributing a game. ZERO emulators distribute game(s).
Unfortunately emulators can be targeted if they circumvent protection as those algorithms are protected by the DMCA. That is why they don't attack SNES or prior emulation.
