You can have infinite copies of actual ROMs since they're just files but proper developers are rare, so I don't think your comparison makes sense. If you scare away enough of the likes of bunnei and gdkchan you're left with... nothing.

They folded because Nintendo has the money to bankrupt them just by suing and dragging out a long case where they would have to defend themselves. You guys are cheerleading a multi-billion dollar corporation using their wealth and power to bully a handful of individuals doing nothing illegal. Well better figure it out then. Nintendo will do it again and they won't stop just because you say: waaaah that's not fair! Yuzu had the best chance to fight back, they made some money on Patreon and also they could've asked for some help on GoFundMe or something like that. But they didn't even try. Why? Because despite what wannabe lawyers say probably a real lawyer sat down with them and told them that Nintendo was 100% right.
