Without the Mandate it is not sustainable in the least and will have to be majorly reworked or it will drive the nation into debt and insurance companies out of business. For instance: pre-existing conditions are still covered but you don't have to carry insurance so you can wait til you get sick and go buy insurance.
That said, maybe these idiots who proposed the legislation should think about whether it is constitutional before they push it through. If they had made a tax increase the size of the penalty and allowed people with insurance to write it off it wouldn't be an issue. This is on the people who penned the bill.

They did. And most constitutional scholars think it IS constitutional. And have always thought it was constitutional.
Can't find thepost, but in the other thread, 21 of the top constitutional scholars in the country, all members of a political think tank, were polled about this issue. 19/21 thought the mandate was constitutional, but 13/21 thought the mandate would be overturned by the courts.
That means at least 11 out of 21 of the top constitutional scholars in the country think the Supreme Court will strike down a constitutional law because of ideological hacks on the bench.
The question of constitutionality has never been a serious topic for debate until republicans decided to pursue every possible course of action to sabotage Obama's presidency, even at the expense of their own legislative goals. And it's only a topic for debate because the court is extremely conservative and has 2 or 3 far-right ideologues whose rulings seem to fall more in line with their political identifications than an objective analysis a judge is supposed to provide.

On the one hand, I don't like seeing conservatives/Republicans politically happy, so I want it to hold.
But on the other, I want it to fail so we can get rid of this insurance industry handout and focus on single payer. However, I'm certain if it fails, we'll never see insurance reform for another generation.Besides that magical "tort reform" that Republicans tout like the second coming of Christ.

The thing I hated the most about the law was the way it was passed. I wish they would have done more to get more bipartisan support and I really didn't like the way not a single person in Congress could be bothered to actually read the bill and know what was in it.

Yea, it's easy to say "well if this fails we'll just fight for singlepayer" but think of all the shit that needed to happen for this piece of shit to pass.
It wasn't Republicans who sank single-payer, it was good old boy Democrats like Ben Nelson, Joementum, and, apparently, Barack Obama. Republicans weren't going to vote for any healthcare bill. But Democrats had 60 votes in the Senate and this was the best they could do.
Unless someone seriously sees Dems getting 65-70 votes in the future, single-payer ain't happening any time soon.

Really? Obama should've known that because that's what Eric Cantor said like, in the first week of his Presidency ("our goal is to make Obama a one-term President"). His naivete has been well documented by now, but maybe it should be reiterated. He believed his own bullshit and got suckered by these guys.
