haha fox news is so shellshocked.

Some guy on there is like "well presidents officially know now they won't know what to expect when nominating SC judges"

As it fucking should be. They shouldn't be voting on party lines, they're supposed to be above that (I know they're often not).

It does please me that at least the SCOTUS is working as intended and NOT just ruling straight down party lines.

barely. This kind of a tax would be upheld 7-2, 8-1, or 9-0 under most supreme court makeups. But not this one.

Kenedy: "In our view, the entire Act before us is invalid in its entirety."

Thank god for roberts (lol)

The tax was alway my go to argument before the oral. but I thought it got shut down when kegan said that obama said it wasn't a tax so it should be viewed that way. thing to learn, oral arguments aren't the be all end all.

They upheld it? Thank you based Supreme Court. This was probably the first time in my life that they've had a chance to directly fuck me with a ruling, and they managed not to.

Yeah ignoring all those black people are people rulings I gotta agree with you. My faith in the system is somewhat restored.

I cannot wait to go to work. This is so fucking amazing. My co-workers have been gloating for weeks about how this is going to be knocked down.

Oh fuck me work is going to be amazing

Holy shit:
Lyle: In opening his statement in dissent, Kennedy says: "In our view, the entire Act before us is invalid in its entirety."

So maybe the only reason why Roberts sided the other way was because, otherwise, the law would've been struck down in its entirety.

Somebody started a thread called "UNCONSTITUTIONAL!!" on another board I visit, jumping the fun and making himself look stupid. Anybody have a good gif of a guy missing a target or falling on his face or something like that I could post? away from my home computer (and gif collection) right now.

::edit::
Nevermind, just went with Shockey.

Bitter tears.

The commies outnumber us. We've just surrendered to the commies hook, line and sinker without even being at war. They've infiltrated us, brainwashed the youth, created a class of people dependent on handouts, and won. Congratulations to the winners.

May the Lord and His mercy quickly come and rule with justice. My country is heading into the sewer. This AFA will bankrupt our economy even more than it is already. Who are they kidding? Who will they steal money from when nobody has any? Oh, foolish me, they'll just keep printing it.

Looks like they may have struk down the part tha forced states to expand or leave Medicade entirely, that's not good if you live in red state because this allows them to optout and that causes the pool to shrink. Not good

My god, I almost got road rage when Diane Rehm first announced that it was struck down. A few moments later and I'm in a much happier place.

I don't love the bill, there really should be a public option (there really should be universal care imo) but I believe this will be better at providing access to insurance and care for more people than before "obamacare".

Wasn't a fan of Roberts, but I think his conscience may have gotten the better of him. Being solely responsible for kicking tons of kids (up to age 26 now) off of their parents insurance, allowing companies to deny coverage for per-existing conditions, and denying coverage to millions more was probably too much for him. Either way, I'm pleased and will now proceed to taste the bitter tears of the right.

This is just a kickback to Obama after he screwed up Obama's swear in ceremony

SCOTUSBLOG: The court reinforces that
individuals can simply refuse to pay the tax and
not comply with the mandate.

which means IRS can come after you. good luck with that. guess i am working to pay others medical insurance now even more.

Why would you think that? Now more people HAVE to pay the tax which means their is money to provide everyone health insurance. If they don't, the IRS comes after THEM to collect the money. If anything, if this ruling didn't get passed, you wouldve had to pay EVEN more to cover the people who never had to pay anything to begin with and wouldve gotten treatment for free at an ER.

Does the ruling say it cannot be justified using the commerce clause or simply that justifying it as a tax is sufficient without considering it?

I'm sort of happy about this. Single payer needs to happen. Or extending medicare to all Americans needs to happen. Maybe this is the first step.

I love how the people criticizing this as "bankrupting" us are fucking war hawks who don't mind spending hundreds of billions on killing people for no legitimate reason. But to spend hundreds of billions or the health, education, and infrastructure of your own nation? FUCK THAT SHIT, COMMIES!

That would've been fun.

That and I doubt Bush gives two shits about this.

I would think they would have a better chance taking it to court after it took effect.

But yes, surprised by Roberts.

And I guess you kept your mouth shut the entire time. Now you can gloat after the fact. Congrats!

How can it be a tax if you pay it to a private company? Or is there a public option that everyone is allowed to choose?

Good, it's not the bill I wanted, but it's a step in the right direction.

The closer we get to universal healthcare the better.

The USA has the worst healthcare system of any modern country, and it's an incredible black eye that as one of the wealthiest countries we fail so hard on that front.

eh? it has the best healthcare system in the world since human history began.

It just has a bad healthcare options

Obama supporters cheering for a big handout to the insurance industry - never thought I'd see the day!

I don't support the law, but it was obviously constitutional unless you think the taxing power is limited to clauses that specifically use the word 'tax'

There is a big MANDATE GONE thread on freerepublic too

Amy Howe:
In Plain English: The Affordable Care Act, including its individual mandate that virtually all Americans buy health insurance, is constitutional. There were not five votes to uphold it on the ground that Congress could use its power to regulate commerce between the states to require everyone to buy health insurance. However, five Justices agreed that the penalty that someone must pay if he refuses to buy insurance is a kind of tax that Congress can impose using its taxing power. That is all that matters. Because the mandate survives, the Court did not need to decide what other parts of the statute were constitutional, except for a provision that required states to comply with new eligibility requirements for Medicaid or risk losing their funding. On that question, the Court held that the provision is constitutional as long as states would only lose new funds if they didn't comply with the new requirements, rather than all of their funding.
.

Wow, Kennedy and the other 3 conservatives would have invalidated the entire thing. Wow.

Well, they pretty much had to if they struck down the mandate. The Court can't go out and find another funding source, and the entire thing collapses without the mandate broadening the health insurance pool.

The classic "Dewey beats Truman" pic would be appropriate.

The "tax" is the penalty that you're required to pay to the IRS if you don't sign up for health insurance.

I can see Obama geting hit for the tax but he can say that you don't have to pay the tax if you get health care which he'll help with and that he disagrees with the SC in their interpretation of it has a tax

lol at the video some religious guy, "if we go to jail," relax dude.

Megyn Kelly on Fox trying as hard as humanly possible to shit on this ruling.

And oh God at that Republican quote. "You have awakened a sleeping giant."

And I guess you kept your mouth shut the entire time. Now you can gloat after the fact. Congrats!

Of course I opened my mouth - I said, simply, that you guys can say what you want, but the fact is this is about the millions of Americans being covered, and the closer we get to everyone being covered, and the easier it is for that to happen, the better. This is not about political boundaries, it's about ensuring our sick, vulnerable and disenfranchised live in a civilized society that ensures that can be protected. People like my mother, who HAVE health care and still is at risk of going bankrupt because of how corrupt health insurance companies are. I continued to say that you should never assume you know what the court is going to do because of questioning during the proceedings.

You can make it a political issue; that's what my co-workers were doing. Republican asshats with no moral center.

But, you're absolutely right, after months of hearing them, I am going to gloat so hard I'll be practically SPITTING in their face. I would gladly lick up your bitter tears too if it comes to it.

People bitch about it now but in 10 years they'll wonder how they lived without it. What blows my mind is old conservatives bitching about government overstep but don't bitch about collecting those social security checks or their medicare/Medicaid.

This is me, except that I work in a progressive/liberal place of employment. It's really more for my social/family circle.
