No. It's more like if he was a regular customer at Best Buy and one day sees that some games are marked free for Reward Zone members, and uses someone else's reward zone card to get them. And then Best Buy says he broke their rules (but not any laws). Now they can take away the games he used the loophole for, ban him from the store, or whatever. But they can not come to his house and take away everything he bought from BB in the past.

Yes, we're talking about a service. He bought the games from a digital service. He has that game on his HD, and it's playable. If he wants the right to access the service to re-download those purchases, he needs to adhere to the TOS and not steal from or exploit their service. Saying he should have the right to access the service he was banned from is laughable.
And that's totally fair.
Still, think it is a worthwhile argument: Should he lose access to what he has legitimately purchased, assuming he legitimately purchased anything?

I'm going to have to try this when I get home, but I am pretty sure you're still able to access your digital games without being connected to XBL or the internet. It'll just warn you that you can't connect, etc, and will then allow you to log into your gametag and access things on your console HDD.
Agreed, and it's bullshit. If I paid for something, I should continue to have access to it no matter what.
It's going to be a major issue in the future when media is largely digital content. 'Ownership' is going to have to be redefined.

Well, one key difference is that when you sign up for Reward Zone you have to agree to their contract, no? Contracts are legally enforceable and TOS,A better analogy would be that he was already a Reward Zone member, but that promotion was only available in Oman, so he then fraudulently filled out a membership claiming he lived in Oman to get games he had no right to download.
Oh--and when he became a Best Buy Reward Zone Member he signed documents saying he would never do just that--and that if he did Best Buy had the right to do basically whatever they wanted to him.

It absolutely is not, if the only way I can access the content I purchased is through that service.
Obviously, the user should not be able to purchase anything else or use the service to play online with others. But that person should still be able to download what was previously purchased.
