TOS is a contract and is prima facie enforceable. E-contracts may be subjected to more scrutiny than regular contracts, but depending on the terms they are just as enforceable as a normal one. A better analogy would be that he was already a Reward Zone member, but that promotion was only available in Oman, so he then fraudulently filled out a membership claiming he lived in Oman to get games he had no right to download.
Oh--and when he became a Best Buy Reward Zone Member he signed documents saying he would never do just that--and that if he did Best Buy had the right to do basically whatever they wanted to him.
See the difference?

It absolutely is not, if the only way I can access the content I purchased is through that service.
Obviously, the user should not be able to purchase anything else or use the service to play online with others. But that person should still be able to download what was previously purchased.
