I pirated 360 games and MS banned me, what the hell?

Well, one key difference is that when you sign up for Reward Zone you have to agree to their contract, no? Contracts are legally enforceable and TOS, while the courts lean toward them, have not been ruled as legally enforceable yet.

Anyway, new evidence is catching this guy is outright piracy...so a better example might be a pirate is rightly banned from a service and then complains while falsely saying that he is not a pirate.
TOS is a contract and is prima facie enforceable. E-contracts may be subjected to more scrutiny than regular contracts, but depending on the terms they are just as enforceable as a normal one. Terms in a regular written contract may not be enforceable either if they are, for instance, found unconscionable.

I told in first post that it's my doing and that i know its my fault. On 5-10 page i told that I'm greedy and that i deserved this.

I have never said that its not fault. It is, I just want my things that i paid for from my account, that's what i was trying for whole morning and day with customer support.

You lose those rights when you violate ToS and get banned. That's how it works. Deal with it. Did the crime now do the time

You intentionally come here to deceive us with a story about how you were banned for no reason, when all along you were engaged in shady activities. It's not the Oman thing that got you banned clearly. Yeah, you fucked up bad, in more ways than one.

You mentioned the exploit, did you EVER play anything pirated on that live account (even offline or on another console)

I honestly think the ban is backdated, since the email mentions Microsoft points, and you've just been hit now, unrelated to the oman incident
 
A better analogy would be that he was already a Reward Zone member, but that promotion was only available in Oman, so he then fraudulently filled out a membership claiming he lived in Oman to get games he had no right to download.

Oh--and when he became a Best Buy Reward Zone Member he signed documents saying he would never do just that--and that if he did Best Buy had the right to do basically whatever they wanted to him.

See the difference?

No, BB does not have the right to "do whatever they want to him." They cannot take away your property. If you downloaded games through that exploit they cannot take away your PC.

If they decided to pursue legal action, they can [potentially] get the police to take it through a warrant, but they can't send BB employees over to take your stuff or repossess your downloaded games.

EDIT: Looks like he wasn't even banned for the exploit anyway, but for pirating. lol at the thread title change.

It absolutely is not, if the only way I can access the content I purchased is through that service.

Obviously, the user should not be able to purchase anything else or use the service to play online with others. But that person should still be able to download what was previously purchased.

We have covered this so many times on Gaf and, while people may not like it, the truth is that when you purchase most forms of media, more directly, computer software, you are purchasing a license to use, not own. That license to use may be transferable, but there are conditions around the license that, if violated, void the license.

If he wants to download the software tied to the licenses he already purchased, would you have any issue with MS charging him for bandwidth? Bandwidth that they have to pay for in order for him to download the software?

I initially held off on the piracy accusation, though my gut was telling me this guy was just the latest in a long line of "using ABGX360 makes me INVISIBLE!!!" pirates who scream at the heavens when its time to pay the piper.

Assuming his admission of piracy (but not on THAT console! LOL) is enough to get him turfed, I can say this GAF member will not miss him.

Mystery solved. The Oman game sharing thing OP did along with potential signs/fragments of piracy is what made the ban happen. I'm sorta baffled by this entire thread and it's existence. I'm not one of those people that spit on people that pirate stuff, nor am I someone that posts "you got what you deserved".

But this thread and the opening post are fucking ridiculous. OP makes his situation out to be that he was randomly sniped and it was some grand ole mystery. Causing people in here to become fearful of their account being banned because they made an Oman account to get some freebies.

Lesson of this thread, if you can't say or post certain information, because of shadiness or being fearful of a ban, don't make the thread. This thread is borderline shit trolling.

Yeah, it's very misleading to try and spread false info here. It was never the Oman games when there's serious illegal business done on the same accounts.
