It's not illegal to sell/buy a dev kit, since they are purchased from Nintendo. Nintendo sells these to Developers. Sometimes members of a dev team or press get to take them when they are no longer needed for review or testing purposes. Technically there's not too much you can do with them without the software tool kit(the software would have a license to the developer).
