IP is fully Sony-owned. But I think the deal was that the game will became multiplatform after a certain exclusiviry window. In case of DS it was 5 years.

It's because Sony let Kojima go to 505 in order to get the PC version game published, since that was before they were doing anything themselves on PC. It's because of this that the PC version of the game ended up on game ended up on gamepass a few years ago, 505 could do the deal without first needing to go to Sony.

Not sure on the 5 years thing, but I guess 505 finally managed to get Sony to give them permission to do an Xbox port. Either that or they found some loophole in the contract that enables them to do it because of play anywhere.
