CBS/AP) MILWAUKEE- A 76-year-old Milwaukee man who shot and killed his teen neighbor, Darius Simmons, after accusing the boy of burglary has been sentenced to life in prison with no chance of parole.

John H. Spooner was convicted last week of first-degree intentional homicide. He acknowledged shooting the 13-year-old in the chest last year while the teen's mother watched.

At a sentencing hearing Monday, Judge Jeffrey Wagner denied Spooner the possibility of parole.

Darius' mother, Patricia Larry, says justice was served when the jury rejected Spooner's insanity plea. She still has a pending wrongful-death lawsuit against the shooter.

Some of Spooner's shotguns were stolen in a break-in at his home two days before he killed Darius. Spooner told the jury he suspected the teen in the theft. Police said they searched Darius' home and didn't find the weapons.

The shooting was captured on a security camera video and was entered into evidence during the trial.

Graphic video of it happening.

Got what he deserved. Still feel horrible for the mother and a kid whose life was taken by an idiot with a firearm.

This man has lived a long life and deprived a boy of reaching even a quarter of his own age. It's a damn shame he didn't check out before having the chance to commit this vile act.

Jesus Christ that was much harder to watch then I thought it was going to be. Kid was just taking out the trash....

Problem is, he probably was mentally ill. Old, senile, fearful and mistrusting. Who knows what'll happen to him in prison. What if he attacks a guard, anything. Might as well give him the death penalty for this if it was available. Save the country time and money from housing this sick old fuck.

If anything, just shows the stupidity of guns. Not only were this guys shotguns stolen, but he killed a child with a gun.

Who knows how many people the shotguns will kill, Adam Lanza used his mother's legal guns to slaughter dozens. But no, you need guns for the random time you might be a victim of a fatal crime.

Why didn't the kid tackle the crazy fucker when he was pointing the gun at the house? Kid had to know he was going to get shot.

Wow, really? You think a 13 year old has the courage for that when he's scared out of his mind?

Sorry, Internet Badass, but not everyone is John Rambo like you. I'd love to see what you do if you had some unhinged fucker pointing a gun in your face.

Just watched that video, what a piece of dog shit. At most he'll spend the last 10 years of his life in jail cause he's so old already. He probably won't even mind since he'll be doing old people stuff like sleeping and going senile. He deserved a worse punishment.

It's not Internet bad assery, dipshit. It's called flight or fight. If someone pulled a gun on me and then pointed it elsewhere while standing right next to me, you bet your ass I'm going to try to make my life longevity longer than the next few minutes. If someone pulls a gun on you, you're probably going to get shot (unless its just a robbery).

This has to be a troll right? Not everyone thinks they'll die. He didn't think his neighbor would start shooting him. Probably thought he was being threatened. What if he tried going for the gun and then was shot?

I'm sorry, I just can't believe you think the kid would be strong, brave, or courageous enough to tackle an armed man double his size at 13 years old.

You must be the most bad-ass 13 year old on GAF.

The old guy wasn't double his size. He's a fucking frail old senile shell of a man. Since his mom was watching, I'm going to assume he was pointing the gun at her, even more reason to intervene. I'm not saying the kid was a coward, I'm saying he had an opportunity to alter the outcome of the situation and missed it.

A lot of people don't think as "rationally" as you do in such situations let alone a kid dude just let it go
Glad there was a video of this so he could be locked up
I hope he suffers

Let's see your quick-thinking display of heroic enterprise the next time someone points a gun at you.

Kid was 13, confused as hell, and probably didn't leave his house that day expecting to be confronted by a crazy person.

He isn't thinking rationally at all. He's too dense to even realize this is a 13 year old kid, not Captain Big Coins.

Fucking hell.

This is like those people who insult people on the 9/11 planes for not taking down the terrorists.

Except worse, because this is a 13 YEAR OLD BOY BEING HELD UP WITH A GUN BY AN OBVIOUSLY CRAZY PERSON.

He called it justice. After they asked him about what he did, in court, he said he felt like it was Justice. He's still convinced the kid took his goddamn guns.

Alyssa Gutierrez was 11 years old when she fended off three attackers with a gun. Go ahead and google her. Make sure you include Internet bad ass with your search terms. Kids can do amazing things in dire situations.

Tackling a guy while he is pointing his gun at your mom (with his finger on the trigger) doesn't sound like such a great idea. Neither does doing the same when he has the gun pointed at you.

You don't ask why they didn't do amazing things when they're just kids. Especially not the way you're asking. What is wrong with you?

Don't tackle dudes because they might have guns, but if they have guns, you should definitely tackle them?

Totally different situation. She wasn't the victim of a surprise attack - in fact, she had enough lead time to scare off her home intruders by loading a rifle and scaring them away.

Alyssa Gutierrez, 11, took matters into her own hands Tuesday when police said when Miguel Marquez, Eduardo Zubiate and Jesus Quintana broke into her home.

Gutierrez armed herself with a loaded rifle.

"I was planning, if they came right next to me, I would shoot them," Gutierrez said.

Not even close to the same situation of being suddenly accosted, unarmed, by a crazy person with a gun. And even if it were the same situation, why does it matter?

Please stop. You're embarrassing yourself.

Couldn't bring myself to watch that video. How is that even on youtube?

It's not particularly graphic. You wouldn't know that the kid gets shot if you hadn't read the story. Old dude blasts him and the kid then runs out of the frame -- it actually looks like he got away.

Doesn't mean you get to lecture the ones who weren't able to.

Christ's sake. You really see no difference between fending people off when you're armed and dealing with someone holding a gun to you when you aren't?

It takes a special kind of asshole to take an event like this and somehow blame the kid for not being a badass. How do you even think like that? Christ.

I didn't lecture anyone. I said he had an opportunity to alter the situation. I see one outcome if someone pulls a gun on me. I'm going to get shot.

Guns are relatively modern. People aren't instinctively afraid of them like they are sharp objects. If you have little experience with a gun you might mentally realize it is harmful, but it won't instinctively trigger a reaction.

What exactly is your agenda here? To victim blame because you think the sentence is too harsh?
