BBC news article

Based in Cardiff, in Wales.

The article mentions his website selling an Xbox with 200GB hard disc, preloaded with 80 games. If they were xbox games, then I'd hope he got arrested for that, not the actual modding, but the article is a little ambiguous

you should search for xbox at craigslist

there's a shitload of people selling modded xbox with 250gb worth of games for like $600, i shit you not

Are you implying that if he had loaded it with 80 arcade or NES games, he shouldn't have been arrested?

I'm more pointing out that 80 xbox games is serious theft. 80 NES games, while still perhaps IP infringing, are not readily available to purchase and could perhaps be considered a lesser offence.

A lot of things (in terms of court prosecution) is dealt by finicial value, not so much of moral value these days. (generalization of course)

So yes, stealing 80 Xbox games is worthy of prosecution, and has a good chance of conviction, while somebody stealing 80 NES games might just get a slap on the wrist.

I remember not too long ago there were strange people at my mall selling a device that emulated & contained NES roms.

selling it with a bios flashed to the chip is illegal.
selling it with any dashboards or apps compiled with the xbox xdk is illegal.
selling it with games on the hd is illegal.

basically if you want to sell modded xboxes, you should install the chip, flash the bios, put the large hd in and use an autoinstaller to clone it to a large retail hd, with no hacked dash or anything. switch eeprom. erase bios from chip again. sell it to buyer with instructions on where to get bios , dash, apps and how to install them.
That would be perfectly legal

Why is it illegal to sell it with a flashed chip?

Because they are derived (hacked) from the MS bios. It is legal to sell them with a bios like Cromwell.

Also, they run afoul of the DMCA by circumventing the copy protection

I see.

Maybe laws are less strict in Canada. This is just my thinking (I don't know the actual laws), but if you purchase something you should be able to do whatever you like with it. I mean you could compare selling a modded Xbox with an illegal bios to selling a computer with the Bittorrent client installed :lol

some dude did that on the NZ equiv of Ebay. This XBOX comes with 80 games for only 1000 dollars! That's about a billion dollars of value!

I posted a question "do all these games come with the boxes and manuals?"

retard was dumb enough to say "no, I have copied these games onto the hard drive from various places, I don't even have the disks"

I reported him and the auction got closed :lol Not cause I give a shit about piracy, 1000 bucks what a fucking wanker.

DMCA is only in the USA, dork!

the EU copyright directive is more or less the same thing. Thanks to the copyright organizations, it's coming everywhere.
