The driver obviously tried to escape the police by trying going around them, not ram them.

His death wasnt justified in that situation

This. If someone is going to ram police then them opening fire makes sense. It can be justified as their life being in immediate danger.

If the person is clearly attempting to go around them then opening fire isn't justified. At that point disable the vehicle. There are more then enough people there to do that as well as it moving slow enough.
