Question about resume and former job

I'm updating my resume and need to know should I include a job which I believe may not give a positive evaluation. I quiet the job in question after several incedences and may be filing a lawsuit against them. No I will not say what it's about, so please do not ask. I will not go into it even after it's been resolved. I worked there for 6 months and aquired some new skills that I feel would make my resume stand out. Just looking for some suggestions. Thanks.

You can put it on your resume, but maybe include an addendum in the packet (or e-mail) that they shouldn't be contacted as a reference.

My HR dept tells everyone that the only thing we should say when asked about a former employee is the start date and end date and salary, if we don't have anything nice to say.

Otherwise, if we give out any negative info it might end up in a lawsuit. Probably won't, but we are too small to risk it.


So you really have to thiunk about what your company would say. They might say "we are involved in a legal dispute" and we can't answer that question - which might scare off the company looking to hire you. Or they might say nothing.

You mention that you did not start the lawsuit yet, so maybe the above is not applicable. If the company has an HR in a CYA mode, then you should be safe listing them.

Listing them as somewhere you've worked is different from listing them as a reference. In theory at least.

A gap in employment is probably harder to explain than the off chance they'll actually call the company you worked for before.

captain made some good points.

i believe by law former employers can only divulge certain types of info like start date, would you hire him/her again? etc.(this could be a state to state thing, i'm not sure if it's federal law).

imho, there's nothing wrong with listing the job on your resume but make sure you explain the reason you don't want them contacted(most applications will ask you if former employers can be contacted).

i've done this a few times and never had problems at all.

Yes, you should list it. If you don't, when you get an interview, the interviewer will ask what you were doing during that time. Also, they can probably find that out when they do a background check.

A background check will bring up that you filed a suit against a former employer? I thought it only checked for criminal issues.

No going to get in to it unless you're family.
