Saudi blood money ruling angers activists

Religious scholar "sentenced to pay blood money to mother after serving short jail term" for daughter's death.

A Saudi man who raped his five-year-old daughter and tortured her to death has been sentenced to pay "blood money" to the mother after having served a short jail term, according to activists.

The man, said to be a religious scholar who is also a regular guest on Islamic television networks, confessed to having used cables and a cane to inflict the injuries, activists from the group Women to Drive said in a statement on Saturday.

Lamia was admitted to hospital on December 25, 2011, with multiple injuries, including a crushed skull, broken ribs and left arm, extensive bruising and burns, the activists said.

They said the father had doubted his daughter Lama's virginity and had her checked up by a medic.

She died last October.

Randa al-Kaleeb, a social worker from the hospital where Lama was admitted, said the girl's back was broken and that she had been raped "everywhere", according to the group.

The activists said that the judge had ruled the prosecution could only seek "blood money and the time the defendant had served in prison since Lama's death suffices as punishment".

The ruling is based on national laws that a father cannot be executed for murdering his children, nor can husbands be executed for murdering their wives, activists said.

I like how father's somehow get special consideration when they slay their family. That's especially enlightened.

How does a man question a 5 year old's virginity? Then proceeds to rape her.

Obviously you have to be crazy to do what he did but I don't get this logic. I'm probably answering my own question.

It doesn't happen everywhere. Saudi Law happens in Saudi Arabia.

This is domestic law, not international blame shifting.

I'm not really the biggest fan of Sharia, or Islam for that matter - but as far as I know, killing your child is a huuuuuuge nono in Islam. Or raping them, or both.

It absolutely is, killing a child is a major offense unless you are the father or husband of that child.

The only thing I could find that says as much is from Umdat al-Salik o1.1-2, which (apparently) says

retaliation is obligatory against anyone who kills a human being purely intentionally and without right.” However, “not subject to retaliation” is “a father or mother (or their fathers or mothers) for killing their offspring, or offspring’s offspring.” (‘Umdat al-Salik o1.1-2).

This is from a translation followed by those who subscribe to the Sunni Shafi´i school, which is like a quarter of all Sunnis - and it specifies both parents.

Still, horrible horrible translation, but I haven't seen any of this fathers/husbands are excluded stuff. Do you know what the quote/sect is?

Saudi courts are closest related to the Hanbali school of jurisprudence and they are of the Wahabbi sect, the specific doctrine motivating this judgement is rather irrelevant giving the amount of contradictory statements it contains, it's a buffet letting them go as extreme or sane as they prefer, which is the issue with Sharia, it's a religious license to injustice for a misogynistic savage culture.

Many Muslims will agree they are filth, they are of course also the filth in control of Mecca and the largest oil reserves on the planet, not to mention the most important Arab ally of the United States.

Being executed for killing your child or your wife would put a severe crimp in the works when you've got honor killings to complete..

These sort of atrocities are pretty much exclusive to 3rd world countries.

Yeesh. What would it take for such laws to change in a country like Saudi Arabia?

Even if they hold that position that still doesnt mean he couldnt be locked up for Life. Saudi = Joke!!
