Tennessee lawmaker makes statement by selling AK-47 on sidewalk

In Tennessee, there are no background check, or even ID requirements, for a private gun sale, which is any sale outside of a gun store. To make a statement of how insane this is, Mike Stewart, the House Democratic Caucus leader in Tennessee, set up a stand on the sidewalk which sold cookies, lemonade, and an AK-47 for $700. Theoretically, any person walking by could have purchased and walked away with the gun.

It was a publicity stunt for his bill that he brought to the floor later:
Early Wednesday afternoon before a House subcommittee, Rep. Stewart presented his bill HB1319, which restricts the sale or transfer of weapons to a federally licensed gun dealer where a background check is required.

House Republican colleagues listened for several minutes to Stewart but did not debate the issue before defeating the bill with a voice vote.

Stewart said his bill ”will pass one day."

He cited various polls that have indicated a majority of Tennesseans support background checks.

As an American, this is insane to me. I can't even imagine how it seems to people in other developed countries.

I sincerely hope he set up who was buying it so some crazy doesn't use said AK to go nuts.

Legit though is there no liability on the seller at all to do any due diligence?

Are they not liable for selling even if someone told them, hey, I'm going to use this gun for nefarious purposes?

That's how it is in most states. As a gun owner, I have no problem with requiring background checks. I'd like them to also have mandatory training, education, and having to meet safe storage requirements.

Yeah, same here in KY. It's not uncommon to see a gun at a Yard Sale.

You actually need a permit to sell Lemonade on the street though, he can't just do that.

Selling the gun is fine though, it's completely legal.

THIS is the reason why we have a gun epidemic in this country. Doesnt matter what one state does when another has lax rules. Almost every gun used to commit crime has always come from states with lax ass laws.

The other senator who's there asking questions does a really good job of showing how absurd it is that you can do this sort of thing. The only people I've met who don't agree with universal background checks are republican senators and gun nuts who subscribe to insane conspiracy theories.

Usually I know the talking points they use for these kinds of things. But since this is so particularly ridiculous, I would need to hear an actual NRA member's verbal diarrhea.

At the end of the day it's always "the second amendment doe".
 
The fact that people get a rise out of this and get proud of a politician that does this makes me realize how dumb the country can be.

It is still illegal to do a personal sale to anyone you suspect or know may not be legally allowed to purchase a firearm. A lot of transfers take place between family members. Not a great reason to not have background checks, but it does get brought up.

Funny/sadly he does because he was selling without a Transient Vendor License

No shit, anyone spending more than 500 is throwing their money away.

Unless it's one of those fancy TWS setups, then it's worth it.

500 would be a fairly good deal for an AK these days. The only ones I've seen that low are WASR-10s and other budget AKs in that range, and that's without any upgrades. Then again that's retail pricing, not used pricing.

This isn't anything new. The laws have always allowed this. The difference is you're aware of it now, so vote accordingly and be politically active.

You're missing the point in the juxtaposing of these two items - the government regulation of Sudafed in any context is asinine when weapons capable of mass death can be sold on the street corner.

Alot of gun owners see things the same way as we do like this.

Too many also believe insane conspiracy theories about Obama going door to door to take our guns.

Also other conspiracy theories like the NRA gives two shits about gun owners, they only care about gun makers.
