Was in my first car wreck. :(

Other than being shaken up and getting a fucked up knee, I guess I'm alright. EMS checked me out and said that if I wanted to go to the hospital, I could...since I banged my head when I was hit.

I was the only one in the car, and I was hit on the driver's side. :( I was going 35 mph (the speed limit) when I was hit. This person was coming from a side street and had a stop sign...and apparently ran it because I didn't see their car until we were literally inches away from each other.

That shit was scary. I mean, I probably froze up because it was an inevitability that our cars would slam into each other.

And although this person admitted to fault, they were trying to blame this shit on me, saying that I hit THEM..when THEY had a stop sign and I had the right-of-way.

Anyway, I thank God it wasn't anything life-threatening.
 
Well, she had the ladies' right of way! You should apologize!

Go to physical therapy
Have lawyer come to settlement terms with insurance company.

Of course it takes a bit but hey....

As long as you were hit on the driver's side of your car, it will be clear to both the authorities and the insurance company that the other party was at fault.

Get lawyer
Go to physical therapy
Have lawyer come to settlement terms with insurance company.
Pocket Cash.


Of course it takes a bit but hey....

This should be your exact course of action. Many lawyers will take a situation like this on contingency.
 
Aww sucks to hear that happen to ya.

You're probably still having a rush of adrenaline going through your body and your sores and aches will likely worsen the next day. Just make sure there isn't any internal damange and stuff.

We're doing it right now for a ridiculous rear end accident we were in 2 months ago in my PREVIOUS car.... I've seem to have become a magnet for accidents lately...

Go Directly to Hospital, do not pass Go, do not collect $200.

You'll get that $$$ afterwards though.

I love how they blame it on you, when they hit your driver door. Last I checked there was no way to drive a car sideways and slam it into the front of another car...

I would have went to the hospital, because if this gets ugly, with court cases and shit, you could have had a hospital report of your head injury and knee injury and this idiot would have had to pay it for you....
 
Why pay a lawyer 1/3 of your settlement that's crazy. If the insurance was trying to dick you around I could see that but, they deal with car wrecks all day. It's cheaper for them and you for you just to file the claim and they will compensate you.

Indeed. The wife was in a wreck about 6 weeks ago in her 2004 Maza 3 hatchback.

Bitch (no license), slammed into the drivers side. She was very sore but fortunately, no bones broke or internal injuries.

Got the car back last week. Close to $13,000 to fix. Unreal.

The vehicle the bitch was driving was insured. Hell, she flipped over.

She has been doing therapy which is scheduled to end next week. Also enlisted a lawyer.


Just waiting now.

Well for one I don't know many insurance company's that engage directly in consumer settlements, most obviously cover repairs and medical bills(and that's via the policy and PiP), but above that?

When you enlist the services of a lawyer, you are expecting him/her to increase your settlement to well beyond what you can get yourself.

A lawyer is not going to do any work unless he can get someting out of it himself.


If it was not your fault, you would pretty easily get enough to cover all the medical bills, etc.

But it does entail more work on your part. We just fax bills over to him.
 
hit from the side, your whiplash shouldn't be too bad. But don't just take the first settlement the insurance offers.

I got hit from behind at a relatively slow speed, and my neck hurt. It felt OK after a couple of weeks so I settled for a reasonable sum.

But now I still get stiffness and aches in it - its surprising how long the effects can last.
 
go to the hospital now and get everything checked out. you're going to be hurting like a bitch by tomorrow/today. if the doctor clears you and you don't need physical therapy (although that sounds unlikely at 35 so close to the impact) you probably shouldn't need a lawyer. since the other party is admitting fault you'll just negotiate the settlement, which will be roughly book value of your car if it's totalled, and enough to fix it if it's not.

I'm just now getting a look at the car (I haven't seen the damage on my car since the wreck...I saw her front right side was completely fucked up and the front right tire was almost torn off. It was also leaking when it was towed away).

There was no damage to the driver door (which it FELT like when I got hit), but my front left side is totally messed up. Also, I'm now seeing that there was damage to the REAR of the car on the left side. I didn't even know that. I guess she hit me so hard that when she spun me around, that side also slammed into her car.

And as for the hospital thing, I'm going tomorrow. My dad recommended the same things that were brought up in this thread.

If you get in a car wreck you can go to your insurance company give them the details and the report and let them handle it. That's what they do.
 
When I went to the hospital, the doctor asked me a series of questions to see if I was thinking straight:

Doctor: "What season is it?"
Me: "Spring."

Right but that's in terms of medical bills and repairs, using your PiP to get hours missed back, but not financial settlement above that.
