WASHINGTON, DC – House Speaker John Boehner (R-OH) issued the following statement announcing that the House would initiate legal action over President Obama’s unilateral actions on the health care law’s employer mandate in 2013:

“Today we’re releasing a draft resolution that will authorize the House to file suit over the way President Obama unilaterally changed the employer mandate. In 2013, the president changed the health care law without a vote of Congress, effectively creating his own law by literally waiving the employer mandate and the penalties for failing to comply with it. That’s not the way our system of government was designed to work. No president should have the power to make laws on his or her own.

“As I’ve said, this isn't about Republicans versus Democrats; it’s about the Legislative Branch versus the Executive Branch, and above all protecting the Constitution. The Constitution states that the president must faithfully execute the laws, and spells out that only the Legislative Branch has the power to legislate. The current president believes he has the power to make his own laws – at times even boasting about it. He has said that if Congress won’t make the laws he wants, he’ll go ahead and make them himself, and in the case of the employer mandate in his health care law, that’s exactly what he did. If this president can get away with making his own laws, future presidents will have the ability to as well. The House has an obligation to stand up for the Legislative Branch, and the Constitution, and that is exactly what we will do.”

So by the time any decision on this is reached they'll probably be implementing that portion. What will the remedy be? Make Obama write on a chalkboard like Bart Simpson?
 
Scalia darkly imagined a system "in which Congress and the Executive can pop immediately into court, in their institutional capacity, whenever the President refuses to implement a statute he believes to be unconstitutional, and whenever he implements a law in a manner that is not to Congress's liking." He added, "Placing the Constitution's entirely anticipated political arm wrestling into permanent judicial receivership does not do the system a favor."

The military already has socialized health care. Tricare is government health care, it's provided by the government for military members.

Yet who would be the first party bitching if anyone tried to make major changes to Tricare.

Truth be told, though, weakening (and potentially revoking) the employer mandate really does socialize medicine faster, since it could potentially get a lot more low-wage workers on Medicaid and away from employer-sponsored health insurance.

But yeah, the irony of Republicans suing the president for using executive powers to do something they actually want to do themselves is pretty hilarious.

Though I could be misunderstanding this ridiculous lawsuit. It's entirely possible.

It's just funny watching Republican's bitch about socialized health care and then support one of/if not, the biggest socialized health care programs in the country.

You know damn well that if Obama came out and annouced that Democrats were working on overhauling the military health care system, Republican's would bitch up a storm.

Same with Medicare, Medicad and Social Security. Those are all socialist programs in nature, yet you mention any changes to them and people blow a gasket. Talk about socialized health care for everyone and suddenly it's a problem.

The press release clearly states the issue of contention is whether our president circumvented congress. I'm not sure if a court case is warranted, but the president is responsible for implementing and enforcing the laws of the nation, not changing them to suit his needs or disregarding them altogether.

I'm assuming I'm just missing it, but I'm not seeing it.

Republicans wanted him to delay the employer mandate. President delays employer mandate. Republicans sue President for delaying employer mandate.
 
Lol this has to be some kind of sick joke. I was pissed that Obama delayed that part but it was a major republican concession basically because nobody was ready. Now they are turning around and using it against him.
