Swat Team Raids Innocent Woman's Home; Lawsuit Filed

An elderly woman's home was raided by police after she was suspected of making anonymous online threats against the Evansville police department and Chief Billy Bolin.

The 68-year-old woman, Louise Milan was in the house with her 18 year old adopted daughter when police shattered a glass door and burst in after throwing flash grenades inside.

Police came up empty-handed in the search for evidence about who had made the threatening posts but only after damaging Louise Milan’s house, handcuffing her and her adopted daughter and seizing their computers, according to a lawsuit that has been filed against the city of Evansville.

The FBI later arrested Derrick Murray, a suspected local gang leader who lived nearby in his mother’s house and was using his smartphone to access the Milan's unsecured wireless network.

City attorneys contend that the force used to execute the search warrant, was “objectively reasonable” and that officials are immune from liability.

I really don't understand these kinds of scenarios. Let's exclude any kind of malice or incompetence and just chalk up to an honest mistake. Property is still damage through no fault of the owner. How is it not the city's responsibility to make it right?

Right? If the police dept apologized and offered to pay for damages, they wouldn't be where they're at now.

And fuck that lawyer for trying to claim immunity. I know it's their job, but come the fuck on.

I would bet the FBI wasn't brought in until after the botched raid.

Lack of compensation for the incident is completely ridiculous and is corporate/public ass-covering at its worst.
 
What? The City still has to pay for that damage.

Was the response reasonable? Yes.
Is the city liable for breaching the house of an innocent person? Yes.

It's not this woman's fault that someone was using her connection to make threats to a public official. If anything the city should seek monetary compensation from this idiot to fix this woman's home.

City officials have said the city paid for the damages to Milan’s house caused by the raid.

But Biesecker said Monday the lawsuit is about more than that.

“There are a lot of different things that they could have done,” he said. “Ms. Milan, all she wants is some acknowledgment that police were wrong.”

I don't blame her, this was some bullshit police work.
 
Yeah the city paid and was liable.

The statement in the OP is the OFFICIALS aren't liable.

So basically the victims are compensated out of the taxpayers' wallets and the actual perpetrators get off scot-free? Sounds about right.

I've been seeing video after video after video after video after news story after news story of cops shooting people, raiding houses, etc. today. When is this insanity going to end? When is law enforcement going to take responsibility? All this seems to get worse and worse on a daily basis, it seems. I'm legitimately worried about our future.

What the fuck is wrong with these guys? Why didn't they smash all her electronics? Do they even SWAT?
 
Having been raided when I was young was probably the most terrifying thing to happen to me. I am surprised the lady didn't die.

This is what I don't get. Some of you are so quick to jump to blaming the cops but forget that they were probably following standard procedure. Some of you are acting as if the SWAT team goes and politely knocks on the front door asking for the suspects. No, they do it this way for a reason: to neutralize the threat inside. They had no idea who was in the house at the time, so they followed procedure and raided the house. It's a shame this happened to the innocent family but the damages are getting paid for so that's that.



Lets all not forget that the orders probably came down from up the ladder. These people were doing what they were ordered to do.

You do not send a SWAT, "Special Weapons And Tactics", team when someone makes an online threat against you.
 
Or to execute drug warrants. Funny how they tend to do this in black neighborhoods

Sometimes, all they need to do is knock.

Every drug bust I've watched happen IRL was executed by the SWAT team.

it was also in the predominately black neighborhoods though
 
Why didn't they taze her? How am I supposed to trust the police to protect me when a SWAT team can't even neutralize a potentially dangerous criminal?

You don't need a fucking SWAT team for online threats that are more likely to full of hot air than anything of any substance, let alone an actual threat. This is getting to be some straight up police state bullshit.
