NEW SMYRNA BEACH, Fla. — An intoxicated New Smyrna Beach man wanted Taco Bell, but employees wouldn't serve him because he was on a bicycle in the drive-through lane, authorities said.
They called New Smyrna Beach police when Gabriel Harris, 33, refused to leave after placing an order at the drive-through window as the restaurant was closing just after 3 a.m. on Sunday.
Reports said police found Harris sitting on the bicycle at the speaker. Police said as officers asked Harris to leave they spotted a Swiss Army knife on his belt loop. An officer reached for the knife, but Harris grabbed his wrist.
The officer wrestled Harris to the ground and arrested him.
Harris faces a charge of resisting arrest with violence.

What was he brought in for? Oh, I see. Drunken Taco Bell ordering mishap. Guy is probably really hungry and hungover in that shot. He just wanted a chalupa, dammit.

Tried to get them to serve him from the drive through window on a bike at 3AM and they wouldn't do it. Cops were called, cop attempted to grab a knife on the guys belt, and the guy grabbed the cop's wrist. Bam, resisting arrest. Yeah, sounds like a shitty confluence of events. Undoubtedly a series of stupid decisions brought him to that point, but I feel a bit bad for him.
 
I don't understand why the cop would be reaching for a swiss army knife on the guys belt loop. They were apparently asking him to leave the premises and not arresting him before that point. He just wanted some tacos damnit.
 
A Swiss army knife on his belt loop... so the cop reaches for it? What the hell. I mean, the guy was being a drunken fool it sounds like, but a tiny pocket knife isn't something I think a cop should be reaching for unless he's trying to escalate the situation, especially if the guy in the mugshot wasn't reaching for the knife at all in the first place. I mean, maybe the mugshot dude was reaching for it, but there's no mention of that in the article.
 
The idea of a bicycle lane for fast food drivethrus in metropolitan areas with a decent size bicycling population might just work. An easier solution would just be to let bicyclists order from the normal drivethru but the novelty of a bicycle lane is too good to pass up.

Does seem unfortunate. He could have avoided the arrest had he left.
 
Kind of stupid not to let the guy order food. It's a drive thru after all, but perhaps his mode of transportation being non motorized violated a taco bell policy of some sort. At any rate, it would appear to me he should be charged for public drunkenness perhaps? Of which they didn't charge him for? Then reached for a Swiss army knife which is probably perfectly legal to carry. Then again, I'm not an expert on public drunkenness laws regarding taco bell drive thru Windows.

The reason why cyclists can't order from the drive through is because they need to have both hands on the handles at all times and restaurants don't want to risk causing an accident. I don't think a bike lane would be coming any time soon
 
Perhaps the a tiny pocket knife was mistaken for a tiny penis. If so, he should file charges for sexual harassment or maybe even attempted rape. The police could then counter with indecent exposure or attacking an officer with a tiny penis.
 
Do people on bikes face the same charges as a person in a car who is intoxicated?
If they can use the roads just like cars, I would think so. But I'm not sure. Probably should be as it isn't smart and it is still very dangerous for others on the road that might have to contend with a drunk person on a bike. Could easily lead to accidents of the biker is erratic and causes a car driver to panic to avoid hitting them.
 
Where I live there are many people that drive mopeds because they lost their license from too many duis. I don't think they can use drive thrus either.
 
I actually don't see why you can't order on a drive through from a bicycle. It would be easier to hide a gun and fun away with money inside a car.

You can still cause accidents. If you drink don't drive. It's just that simple.
 
Ridiculous that drivethrus don't serve people on bikes but they'll serve me if I'm on my motorcycle, where I have to stop, open my bag, put the food in, put my gloves back on, etc.

The real reason is because Americans are too uncoordinated to be able to eat, ride a bike and clap during their meal, all at the same time.

Depends on the state. Some states do not allow for DUI charges for cyclists. North Carolina, for example, just outlawed it last year.
This seems stupid. Why would they take out DUIs for bike riders. They use the roads just as well and an erratic bike rider is incredibly dangerous and can easily cause a crash.
 
I always thought it was stupid as hell and unfair to hold people to the same charges and punishments for riding a bicycle drunk as they would driving a car. Come on....you're really only endangering yourself. You might endanger someone else, but that's a real long shot.
