SCOTUS strikes down gay marriage bans, legalizing marriage equality nationwide

SCOTUSblog:

The opinion seems to go out of its way not to state a standard of scrutiny. Instead, it says, "It is now clear that the challenged laws burden the liberty of same-sex couples, and it must be further acknowledged that they abridge central precepts of equality . . . Especially against a long history of disapproval of their relationships, this denial to same-sex couples of the right to marry works a grave and continuing harm. The imposition of this disability on gays and lesbians serves to disrespect and subordinate them. And the Equal Protection Clause, like the Due Process Clause, prohibits this unjustified infringement of the fundamental right to marry." That's page 22.

I had no idea this topic was coming up in SCOTUS so soon. Kind of blindsided. Historic day it is. Guess I'll remember this as one mundane friday for myself, one historic friday for the Nation.

Crying like a baby.
We'll head down to the marriage license office later today. We've been waiting a loooong time.

Argle-bargle, bitches!

Dammit, it looks like it's another Kennedy opinion that waves its hands around and comes to the right conclusion but doesn't really explain very well how it got there. This isn't exactly surprising, but I was really hoping it would touch on some of the broader equal protection questions in regards to sexual orientation.

Roberts:

"If you are among the many Americans--of whatever sexual orientation--who favor expanding same-sex marriage, by all means celebrate today's decision. Celebrate the achievement of a desired goal. Celebrate the opportunity for a new expression of commitment to a partner. Celebrate the availability of new benefits. But do not Celebrate the Constitution. It had nothing to do with it."

And it's Pride Weekend here in NYC... Things are going to be NUTS.

This is great news!

Not really, no. They have to listen to the Supreme Court, whether its 5-4 or 9-0. Only potential problem with a 5-4 decision is it makes it slightly more likely to be overturned in the future if some of the liberal judges get replaced by conservative ones (AKA make sure to vote Democrat instead of Republican).

This was probably what I heard. Yeah, let's hope this doesn't happen. Happy for the country today and amazing it took this long.

I figured he'd take that angle tbh. Kind of funny to see it in writing though.

Take the victories you can get. Politics is a game of steps.
