SCOTUS strikes down gay marriage bans, legalizing marriage equality nationwide

That despite the claim that one can't disagree with a Supreme Court ruling, one in fact can. And when someone does it's not valid to dismiss their interpretation with "the Supreme Court says otherwise" when the persons entire deal is that they disagree with the Supreme Court's interpretation.

You can criticize their decision but they cannot be wrong. They are the highest court of the land, their interpretation of the constitution is how our country must legally interpret the constitution. That interpretation can change, years from now a different set of judges could find that the constitution says otherwise, and of course the citizens of America can amend the constitution in disagreement with the court, but as of this moment in time the American constitution factually ensures marriage equality among all consenting adults.

At least that's my knowledge on the matter. If I'm wrong please correct me.

Thank you?

It depends what one is claiming. If one is claiming, for example, that something is "unconstitutional" when the court says it is not, or vice versa, then what response is there other than "okay, well, great opinion, but the Supreme Court is the arbiter of what is constitutional so until they change their minds, you're incorrect by definition". Presumably people posting on GAF are not brilliant legal minds working on trial balloons to overturn some precedent by making some novel legal-theoretical claim; rather, they're likely mostly non-lawyers concerned primarily with public policy outcomes, right? Certainly I think the court can make the wrong call sometimes (there are times where I agree with dissents more than rulings), but I'm not going to pretend that the dissent has more legal force or is more binding.

If the argument is principled and normative, then it seems reasonable to disregard the court's interpretation, but it also seems reasonable to disregard the US Constitution more generally. I'm fine with that: money isn't speech, the KKK should be banned, no one should be allowed to own a tank, federalism has no inherent legitimacy, the death penalty is wrong, direct election of senators is unnecessary (hell, the upper chamber is largely unnecessary), all felons current and past should be permitted to vote, etc. etc.

Forgive me for asking if this was already answered, but where the hell did this come from? I saw no one talking about there being a vote on this within the past few days, which normally would have been huge news. The first I'm hearing of it is today, when it was declared a right. Why was no one talking about this before hand?

Oops haha, sorry. I get most of my news from GAF and Reddit, so I'm kinda of used to seeing a thread with a title that would have informed me of the decision (a la "Supreme Court to vote on gay marriage ban tomorrow").

Did you miss the GAF thread that's been around since April? We knew it was going to be the end of June but not the exact date for months now.

Feel happy for everyone out there, I have a number of gay colleagues who are going to be pretty ecstatic/relieved. Unfortunately, the social conservatives in my store all work around me :-P Not looking forward to tomorrow, but I'll suck it up for a few days.

with all of these people exclaiming that this is against god - do they shout so loudly about other sins supported by the state - such as the right to have sex before marriage, or divorce?

If you're going to be irrational and play the religion card, you should at least do it consistently.

Religion is made up

If he (God)felt so strongly about this ruling he would come down and say something

The days of hiding hates behind ancient texts are beyond over

This really was a great start to my day. Glad for those whom will be effected by this. Maybe humanity is not just trash after all.

18th in the world. Seems about right.

But #1 in freedom

You have an incredibly narrow view of religion.

So does this mean a gay couple could get married tomorrow, today, RIGHT NOW if they wanted to? What other hurdles might they still face? I'm assuming some individual churches might still refuse to marry a gay couple?

Regardless, this is a huge step forward and I am extremely happy. :)

Churches can do whatever they want and are not needed to issue marriage licenses. Some churches do marry gay couples, many don't. That likely won't change much.

Update from the frothy guy:

The Court has ruled but now the People must speak. Join me & fight for marriage #RICK2016

Yes the people must speak. We the people aren't so sure we like this free country thing any more. Can we try how Saudi Arabia is doing it? I like their style...

Still no tweets from Sarah Palin. :(

Yes, a majority of them. I grew up thinking it was wrong myself.

I changed my mind around 18 or 19. I'm 32 now.

I bet they never changed, though. Not that I'd honestly expect them to. Totally different time, and have lived with those beliefs for soooo long now. I had those types of relatives too, but luckily my mom is the "black sheep" of the family, (read: non religious and openminded) so I was in an environment where I didn't have to follow their lead. My mom taught me to love everyone no matter their differences. I'm so glad for that, looking back now.

I am extremely lucky that in my facebook feed I have people from all political sides, and all have been polite.

What are conservatives saying they need to "fight"

What fight? There's no "fight" to this. This is the end. The final ruling. They cannot appeal any further and laws cannot be made to contradict this ruling.

There is literally nothing they could (legally) do to "fight" against gay marriage

They're fighting for the right-wing vote.

To be fair back in 2004 I probably thought the same.. or just simply as a whatever-issue since I was much younger and dumber and didn't care or need to care; I was informed by conservative ideas (mostly residual from my parent's parents thoughts), and who used "that's gay" as slang.

I don't anymore and the news about it being legal has me so freaking happy for the USA! I hated that I thought so narrowly now, but hindsight is 20/20 and politicians I'm sure have compromised their feelings for votes and have changed positions on matters as new information rolls in.

It's also Pride Week in Canada and its been just all around a wonderful week to celebrate love in all shapes in forms. Happy, happy day! And a happy pride to all. :)

And some Utena and Anthy to celebrate for being ahead of their time

I was the exact same way. However, similarly I've matured and grown to believe in gay rights. Today is an amazing day for everyone!

Lots of talk about the Revolution and the Civil War on talk radio today, especially Glenn Beck.

I never understand how so many GAFfers have socially conservative facebook friends.

Mine whittled themselves down, but maybe that's because I'm just so darned confrontational all the time :D

i dont block people being people.. if i blocked everyone i disagreed with, there would be no one... its jsut some subjects seem to hit a higher note for others

A little music to celebrate with...

Uhm. Is that real?

"Please remember I make music"

What an ass.

The fuck!? lol..

Is he retiring?

What a piece of shit.

Edit: IT SOUNDS LIKE SOMETHING HE WOULD SAY THOUGH!!

Thank you?

You'd think by now people would have learned that if they don't have the little blue verified checkmark next to their name, it isn't actually that celebrity's Twitter account...

They could cease giving out marriage licenses altogether, and call everyone's marriage a civil union. I think that's what Mississippi and Louisiana may do. Maybe Alabama.
