This is weak stuff even for an Originalist argument, imo. The 14th Amendment does not call for equal protection solely or primarily or mostly for black people, or even "on account of race, color, or previous condition of servitude" as the 15th Amendment explicitly does for voting rights. Statutes like this are written broadly for a reason; if they had wanted to limit it they would and could have.

As for the lack of expected references to tiered scrutiny, those are merely a practical set of precedent-based guidelines that evolved organically over time, with no particular basis in either the Amendment itself or whatever intent we can presume to divine from the mind of John Bingham when he wrote it. Why anyone insists that the court adhere to it, I'm not really sure, except out of a reverence for tradition and subsequent vain attempts at a semblance of consistency. They can certainly interpret the Equal Protection Clause without its aid.

Checked, and apparently my hometown in texas from my childhood days is refusing to give any gay couples licenses 'until they get instructions form the attorney general'
I figured they would pull that card, given how rural the place is. A lot of pretty religious conservatives in that area dying to find a legal way to continue discriminating.
When he drops out of the race in a few months, I'm calling in sick to work so that I can mock and enjoy. The bastard.
Personal note:
This day is a day I've waited for for a loooong time. There was this thought in the back of my head that took seed after the disaster that was Bowers v Hardwick: these major issues will be settled in court. This would be especially true for those of us who live in the backwards-ass South; we'd need the force of the federal court system to force our states to live-up to the U.S. Constitution's guarantees.
Thank god that we have a friendly judiciary and a President who'll be willing to force compliance with this court's ruling. There will be weddings in my hometown soon. For many, the long wait will soon be over.
