They purchased photography/art, modified it, and used it in game. So, morally and legally fine but seemingly worse than creating the art assets themselves.
What...in the hell...is that?
The plot thickens...This is getting very meta but... that quote was actually stolen from Picasso:

Haha, expected the amount of over-reaction this has got, not surprised in the least bit.
Still not ok.

You're basing this on what? How much of your hypothesis is biased by your hatred of the company?ND really have the worst fanbase.
Not familiar with this picture, but is it supposed to bear resemblance to The Quiet Earth?
In the video game industry
This is exactly why gaming isn't like it used to be. Because it has now become a business. Not a hobby.
That really didn't read like a sarcastic/bait post.I think someone took the bait
Wow. I bet Ubisoft took the concept from some other source when they made this picture for black flag. This is a big deal because of the american judicial system and how you can file a lawsuit over anything. This was clearly an honest mistake because I am sure Naughty Dog does not need to borrow ideas from Ubisoft in order to have their vision realized for Uncharted 4. Regardless, i think Eurogamer should thank Naughty Dog as well as other gaming journalist websites for giving them an opportunity to create an article that will attract a ton of web traffic for the next day or two. That is the kind of influence Naughty Dog has on the gaming industry. They are that good. If only an indie developer stole that artwork for their trailer, no one would even notice. It's a shame that Naughty Dog is such an accomplished gaming developer because they will always fall prey to such scrutiny.
easter egg?
I honestly think that this is what's going to happen. They're getting called out and within the next two days that trailer is going to be replaced. We will all yell at each other for a week or two, and we will forget about it because we don't know what to do about itreupload a new cut of the trailer...never happened everyone needs their eyes checked
It's the ice burger that will sink Naughty Dog.Maybe is a real Island?
They went to the trouble of removing the assassin. Someone knew what they were doing.
Tali one was better!
Hey guys. I just heard a rumor that the Naughty Dog concept artist and the Assassin's Creed concept artitst are good friends and went on a location scouting trip together where they took a photograph of the exact same location.
Ah, thanks.Nah, that was a different thing altogether. Basically if you google "space winter" there's like a million identical images to that one, so together with Bioware using a stock photo to make an important character's portrait it was an indication of them rushing some aspects of the game, or just not being that creative overall.

You may not like it or find the reveal underwhelming, but there was nothing illegal or stolen in that image. Stock or not Bioware paid for the rights of that picture and used it as it is their right. This Uncharted concept art thing is (we can only assume) an entirely different thing.
ND should come forth with an explanation or an apology and issue a new trailer with the change while silently feeling fortunate that this was pointed out before launch thanks to a trailer and not after!
I'm not familiar with what Bio did. Can you tell me?

Thanks to your post I found this gif and will keep it forever
That is what I was about to post. They took the time to photoshop out the assassin and used the scene as a quick and dirty job. They were well aware.
Also, some people are getting confused with thinking the beautiful beach scene from the game is what is in question here. No, they ripped off art from the AC IV concept art book and used it as picture in the game.
