Judging by the glass falling from the windows and the bullet holes in the front windscreen it was the driver.

He was driving toward them. In USA that is considered assault on a officer with a deadly weapon. He had every chance to stop.

He was armed with 4,000 pounds of steel and driving it towards the cops. What else are they supposed to do? It also doesnt look like they killed him.

A vehicle can be used as a weapon, too, you know. Especially when you drive it through neighbourhoods at high speeds. I'd say taking a shot and stopping the chase at all costs when you get the chance is preferable over him hitting another car or a pedestrian or something.

Not yet it wasn't. Driver was cornered and attempting to go off-road around police blockade. Expected tires shot or another car to try to block that attempt instead of unloading shots. Still, guy was reckless, and in minutes the country would be out in public taking kids to school and leaving for work, this guy was rampaging through that with a dangerous weapon(his car).
