People really need to stop pretending marketing agreements really have a big impact on whether third party games come to Game Pass or not. Any game that gets a marketing agreement does so because they want to maximize sales. Essentially what Activision says here.

It's so weird that people are acting like the last few weeks didn't happen. That somehow EC moving on to their concerns about cloud means that's the only thing they are concerned about. Yet just weeks ago people were saying EC didn't care about cloud, and MS was only addressing their console/pc concerns.

With xbox long list of mismanagement of studios and piss poor performance in the last several years.. anyone that really likes gaming should be frowning upon MS acquiring stablished studios/publishers with beloved IPS

Anyone that have memory and two brain cells knows of MS past market strategies to mantain dominance on certain areas and should also be at minimum worried about they finally unleashing said practices on the games industry with the full power of their trillions windows dollars

The rest ? Is fanboys too stupid or blind to see the train rack coming a mile away

Some people want to read whatever they want.
And unfortunately being fostered by pseudo influencers and twitter personalities that tell them what they want to hear doesn't help either.
They think that EU is going to accept whatever Microsoft offers, if it was so simple they wouldn't have delayed their final decision already twice.

But the Mlex report doesn't indicate anything about this. It only says what MS has done (focused on cloud gaming because that's the type of deals they have been able to make with smaller cloud gaming providers, e.g., Boosteroids and Ubitus).

It does not mean that EC has changed or made its focus to only cloud gaming. They may still have concerns regarding consoles that MS may not have addressed.

This is just a cop-out by Microsoft. If there can be a 10-year contract, there can just as easily by a "forever" agreement, unless they have ill intentions of pulling COD as soon as the 10-year period is up. And that's the reason why they first offered a 3-year contract, then a 5-year contract, and just now a 10-year contract when the going got tough.

I would say that the chances are that whatever is being planned for the next round of hardware is probably fairly easy for both Sony and Microsoft to predict, and perhaps that was not a great example, the point is that no business can make a pledge like that forever, you'd have to be crazy to think that asking for the game to be available forever through every iteration of Sony's hardware no matter what they do is reasonable.

It's not a cop out, I'd say it's a really reasonable commitment. If they'd bought Activision ten years ago, they'd be talking about releasing games on PS3, PS4 and PS5.

The hoops people will jump through. If "forever contracts" were a thing then why don't they already exist for some franchises. Why don't they exist in other things. Why do sports stars sign five year deals if they plan on playing another fifteen? Why do content providers sign one-three year deals with Netflix if they still plan on existing and providing content after those three years.

MS doesn't really need to provide jack squat but they're doing so to make it obvious they are treating CoD like Minecraft.

I have to admit, sometimes it's really tempting to block some of the weirdos. But then you could miss up on interesting topics, because those are mostly the people who google all day for good/bad news to serve the cause. For example: How could i live without daily anti VR threads? Exactly, not at all!!

Clearly Sony didn't have a choice when it came to keeping the MLB license and making versions for all platforms. If they had no sway with a long term partner like MLB to block game pass on The Show of all games, I find it hard to believe they are able to block anything else without a deal for marketing.

My question still remains, do we have examples of Sony blocking game pass from games they don't have marketing deals with?

Nope, I understand it very well. Three and I went into detail, and like I said back then I would also call it a dick move if Microsoft would only let a game on PS+ but not directly on the PS store.

If you feel differently that's ok, not everyone has to agree on every topic. It has nothing to do with understanding, just a difference in opinion.

The only example we have of anything is the RE Village marketing agreement, I believe. Everything else is assumed.
 
My assumption is Microsoft's remedy package proposal is a global remedy package. Maybe The EC did narrow it's concerns to console and PC, but the CMA is focused on cloud. So if Microsoft's proposal heavily included cloud remedies, maybe there's some misreporting that cloud is the focus for the EC proposal.

I don't know though. I doubt the EC narrowed it's focus to just cloud though.

In both articles there's no mention about the details of the proposed remedies because it seems both MS and EU refused to comment, although it's clear that at the very least they offered all the contracts they have signed recently.

So tell me this. Why didn't Steam sign the 10 year deal contract with ms. Why are there no current contracts with ABK. Why don't we hear any developers or publishers signing any set amount of years with Steam. Where are the 10 year deals with Apple when releasing apps on their store. Do folks sign 10 year deals when selling on ebay, amazon, newegg? No, because they aren't needed when you're selling a product. MS plans on pulling the product away hence why there are these 3-10 year contracts.

Your Netflix and sports analogy are not the same. Netflix is a subscription model. Sports stars sign contracts so they can renew for better deals.
