So the holdup with the cma is the cloud right that's it? I'm sure ms has been prepping for months for ways to mitigate this etc the deal is too big for them not to make concessions with the cloud I honestly believe it has a good chance of closing

CMA doesn't do backhand deals or make a deal and lies to the public they are still investigating.

Yeah I keep saying I want off this ride but then something interesting will come along that's a bit entertaining then it just goes back to mud slinging again... I will be glad when this is over regardless of the result.

Of the three regulators who could theoretically stop this merger, EU passed with some remedies, CMA blocked and the FTC got rolled over in court..

The FTC is fighting as much as they could, but they failled, the "tough" CMA blocked which should be the end of all this, but no to Microsoft, they put so much pressure on the CMA that they caving.

I think Microsoft could buy Take 2 without much a issue because

EU doesn't care, since Xbox is insignificant in the region

CMA got spooked

and the FTC gonna get rolled over again in court.
 
I think that it's now a no-brainer to extend the merger agreement, even if the CMA doesn't immediately accept whatever MS offers on Monday.

Why settle for 3 billion when you can get much more? Worst case scenario you still get that 3 billion.

I don't think they have to extend anything. They can just keep moving ahead w/ the CMA process, and ATVI can just choose to not breakup the deal and take the fee.

I would expect the only direct intervention they will make is take all ABK properties Xbox exclusive, same as with Bethesda. They actually seem to have minimal oversight of Bethesda besides not allowing them to develop for Playstation.

I don't think the deal is still alive. i think Kotick is taking the money and has refused an extension, and Monday's CMC at the CAT will be to formally withdraw from the appeal process followed by Microsoft announcing they stopped their merger.

Beating the FTC was just bragging rights IMO.

Yeah MS knows they need to wait until the CMA agrees. If they close before then they risk antagonizing them.

Kottick would be stupid if he does that. Plus he is not in position to walk out. The chairmens(top people) have to approve it.
