Seriously though, forget the why (which is silly enough on his own) and bend your brain on the impossible logistics required to pull it off like he did.
Seriously, if they had implied that even ONE other cop knew he was still alive I would buy the whole scenario a bit more, but they don't appear to know. What people are also forgetting is that Gordon's death faking was not planned. He saved the mayor and got knocked out. The GPD Cheif is already dead and the next in line guy is also "dead", it gave Joker a false sense of control. Atleast that is what they thought, until it turns out Joker's plan was to get captured to get Lau.I always thought it was to protect his family as he clearly said. The Joker was seen to be rather merciless in his attacks. There's no guarantee that the judge was going to get into that car alone (what if she had her kid with her) and there was no guarantee that the commissioner would be the first to sip that drank (what if his kid had sipped first). He also dropped Rachel out of a window rather willy nilly.

Stupid Jim Gordon death sub-plot. But I'll be honest, for the first viewing I got pretty hyped when "We got you, you son of a bitch!" happen
It was all about the dramatic effect really. Nolan, like most film makers, do things that will gain some sort of emotional response whether or not the circumstances actually make sense.
Like toward the end, instead of trying to sneak and get the jump on the Joker (and two dogs) he just sort of... walked up to him. Even in the theaters I was like "huh". Especially after the party scene where he just kind of appeared out of nowhere.
Stupid Nolan.
