I seriously doubt the US government will try anything vis a vis FRAND. They can say they will, but my instincts say no.

Motorola is under investigation by the FTC for FRAND abuse, Samsung is under investigation by the DOJ for FRAND abuse, the Xbox FRAND verdict was was remanded by the ITC and sent back to the judge because of the FRAND issues after there was an outpouring of protests from Congress and various tech companies about the decision. Samsung and Motorola are also under investigation by the European Commission for FRAND violations.

The whole FRAND abuse tactic by Android OEMs was a desperation tactic that had no teeth and won't get them anywhere in the US or EU. Products like Xbox and iPhone are not in any danger of getting banned because a company like Motorola decides to start abusing FRAND agreements.

I'm thinking surely there's no way on earth that Apple can escape this without 90% of their design patents being invalidated due to prior art.

Then I remember that Apple is an American company and the jury is American.

Sad day for anybody who cares about openness if Apple win :(
