Yeah, surely the Avengers and Cap know better than the X-men when they are dealing with Phoenix force. I mean it's Cap. He and the Avengers didn't escalate the situation at all. Mind controlled individuals don't deserve handcuffs if they were Avengers.

Scott wasn't looking to host the Phoenix for himself. That was what the Avengers did. AvX constantly depicted the P5 not in charge of their actions 100% and the force amplifying their most negative attributes. Hell, Scott was the most in control until he was pushed over the edge.
What it boils down to is that , you can't blame the Phoenix 5 for their actions. If Cap believes the Phoenix 5 desere prosecution and they so do many other superheroes.
Anyway Scott, Emma et al. are gonna get their redemption arc , or everyone will forget about it, à la Iron man.

I just finished Morrison's New X-Men. As someone who's been reading comics for about a month, I'd say that was a pretty damn good introduction to the medium.
Can we not post any spoilers in here about NYCC? I'm playing check up on ASM.

Conveniently enough, I cracked open Astonishing immediately after finishing. UXF is definitely on my list, too.
Dan Slott is the worst writer on Amazing Spider-Man since Howard Mackie, and he was the weakest in the brain trust.
Slott is pretty solid and I'm enjoying his stuff on ASM, but I think all three of those put out much better stories than Slott did during Brand New Day.
