So much misunderstanding about Miranda on the news. It's a non-issue right now. Guy is wounded. You can be placed in investigative custody/detained. They probably don't even know what the charges are right now that they are going to arrest him on. Guy has to be taken to the hospital to be treated. You don't have to read him Miranda until he's under arrest and start asking him questions. Even then if the guy is talking WITHOUT being asked any direct questions without being mirandized, you can still use those statements in court. They call them excited utterances or something and courts have held that they can still be used. Example: Guy shoots his wife. Cops show up. Before he can be placed under arrrest, he starts screaming "Oh, God, I shot my wife." He wasn't being questioned and he wasn't under arrest yet, but you can still use that statement.
I've seen enough CSI Miami to know this isn't true.
 
If he was having a normal Wednesday, it appears he wanted to go on with his life. Why did he not even attempt to hide face at all when dropping the backpack? Did they not realize how many cameras there are in this world?

Nobody has to be read Miranda - not sure what people are talking about - only has to do with admissibility of the statements, nothing else. Its not an unconstitutional arrest or some shit

They can only invoke the public safety exemption for around 48 hours. The point of not reading him his Miranda rights was explained in that quote: They want to get additional intelligence about future incidents.

Agreed. I was so distracted at work today! I actually left my desk and went to another office that was not being occupied. Did not want to be seen paying attention to GAF + streams :P

Yes, obviously the left criticizes the right, too. But it's patently incorrect if you think it's comparable at all

I'm not aware of the Democratic Party holding up nominations, holding hearings, and espousing the position that President Bush covered up the attacks on September 11 (as the right did with Obama and Benghazi). Sure, a few radicals like Cynthia McKinney but it wasn't a mainstream position and those that had those positions were quickly voted out.

I'm really curious about White Hat guy's story. Everything you read about these two brothers indicate they were quite different in their attitudes and demeanour, with the older one being one of concern for the family.

I'm not yet convinced they are Jihadists.

No, they will question him about other potential suspects and devices out there. He will then be read miranda and be given legal counsel if requested
 
Of course he's going to stand trial. They wouldn't have gone to such lengths to take him alive otherwise.

Actually the reason for bringing him alive is to squeeze any sort of intel from him. The trial is just the dog & pony show for the public.

Call it blunt, but thats all what trials really are for these types of high profile cases.
 
What is scary about this whole ordeal is that 2 kids caused 5 days worth of commotion in one of the largest cities in the United States. Imagine if there was a group of people like these 2 brothers that try to do something like this again, but in numbers. They can do some massive damage. I'm just glad this is over with and we get to find out what triggered these two guys.
I think that's the big concern right now, which is why they wanted to capture these guys alive for questioning.
 
Of course he's going to stand trial. They wouldn't have gone to such lengths to take him alive otherwise.

i didn't mean ever. They would normally have to get him in the first time within 24 hours no? I can see it being a little bit... delayed (besides for health reasons)

That is why I am happy he is still alive. I really wanna know his motive for it. His tweets show he is a normal guy plus those photos. Big bro had to say something to him.
 
How did he not? He was holed up, wounded, inside a boat, with a load of police surrounding him and still he was firing at them - he did everything but (thankfully) blow himself up
If someone fights to the end against a bunch of cops/agents, they aren't coming out alive.

Wow. I really don't think they thought they would be caught.

I think they were thinking if they got up and left town, leaving school, job, family etc, it would arise suspicion. I think once they saw the FBI has some decent photos of the guys, they realized it was time to leave.

Probably not. its still a relatively new thing and its usage in manhunts has never publicly reached this level before.

What I am convinced is, is that the older brother was a massive influence on White Hat's thoughts and actions. He had youtube links, message board posts, etc supporting a man who thought the actions of Jihad must be taken at all costs.
