Nintendo completely owns Eternal Darkness; SK still working on legal issues

The problem is that with great games like RE5 , Silent Hill home coming ,etc. This game will have problems to sell
 
They funded 2 games in the series and thus they co-own those titles. Tecmo is still free to re-release all other Fatal Frame titles and develop new ones on their own and on the platforms they want to. Just a few weeks ago, they put FF1 and FF2 on PSN.

Yup, this pretty much confirms what I expected. Precursor is in no position to really make this game, and the kickstart campaign was just to fund something that they could develope enough along to pitch back to Nintendo to publish. Shadow of the Eternals is never coming out.

This is jumping to conclusions. Man some people on GAF really have a vendetta out against anything related to Dyack.

It has never been said to be a sequel to ED. A "spiritual successor" legally I think this is OK.

Any assets used in a pitch is just that a pitch. They can keep using those assets on another game if development was never greenlit after the pitch with a publisher such as Nintendo.

Why do people think they are going to take money to repitch this to Nintendo? They came up with an episodic model for a reason, smaller amounts at a time for funding purposes.

Nintendo doesn't own insanity. They own the method that was used for sanity effects. This doesn't mean someone can't come up with another model/method outside the patent that was used for the sanity system.

Some of the funding could also be to pay for the rights to use the sanity patent from Nintendo possibly.

Yeah, and now go back on those sources and you will find out that they don't know shit. I've been going through the same thing over and over again as people are still convinced that Nintendo co-owns the IP. There's absolutely NO evidence for that.


Or maybe they have no rights over the first three games and only the new ones.

Rights to all games they funded.

Ahh, that must have been what confused me, although I am surprised that Nintendo were OK with most of the staff being "poached" by a former(?) employee, especially given how they dealt with a similar situation at Retro.

We are the worst forum after all, & to be perfectly honest I am shocked that anyone would have any faith in the man given the underhanded way he has handled himself post Too-Human (trying to "rip off" one of the few competent publishers out there), anyone prepared to give him money needs their sanity checked.

Dyack mentioned that Nintendo was fully aware of the project from the start, if they didn't pick this up before I doubt they will now.

I think it's more likely they make the game exclusive to WiiU then Nintendo leave them use sanity effects at will, and avoid any legal issues, that is if Nintendo is interested, of course.
 
It's going to be really funny if Retro's project turns out to be ED2.

So if what your thinking is true, this will be what the game looks like in a year or two.

- Renamed to Eternal Darkness 2
- PC version cancelled, now Wii U exclusive
- Has the full effects of Eternal Darkness 1

If Nintendo were dumb enough to put their own money behind a game that has proven to have little to no consumer demand, yes I suppose this could happen.
 
Mario Kart U is actually, perhaps the most wildly unreasonable proposition for Retro Studios full stop, it's staggering to see EatChildren/Nirolak behind it.

I always get the feeling they know something and just like seeing people squirm and get close to losing their minds at the possiblity of Retro working on Mario Kart again. Especially since it's a real possibility.

I would lay money that Retro will have worked on the next MK.
 
This is definitely crazy, but I've gotten the sense throughout this campaign that Precursor is trying to prove to Nintendo that ED is still viable. Kind of like what Rob Thomas did with Veronica Mars? If they can hit their stated goal, maybe it becomes a true Eternal Darkness sequel with Nintendo's support? They've been so cagey in every interview about who owns what, what they're allowed to use... what if that changes based on how much money they raise? Maybe that's why they're being so evasive?

Well, it's a spiritual sequel, so at best it's going to be a sequel in the same sense that Dark Souls was a storyline sequel to Demon Souls.

But beyond that, it won't ever be a sequel-in-name because there's a PC version. Even if Nintendo could be convinced to let them use the license, they wouldn't allow it on any non-Nintendo platform.
 
I'm very sure they own the rights for any new game/spin-off, but not the older games.

All they are basing it of is the fact that FF2 lists both Nintendo and Tecmo as copyright holders for that specific game. That website simply jumped to wrong conclusions based on that, unless you can provide any evidence that shows that Nintendo does indeed have these rights. There's simply none I could find.

sometimes you have to wonder about the knowledge of the average 'hardcore gamer'.
yo'd think being part of the enthusiast crowd would mean people possess a little more knowledge than the average joe.
