The term "Xbox Now" is only trademarked in Europe and it's only for G&S "Audio, video and multimedia broadcasting via the internet.", as I wrote in the TalesFrom4ChansAss thread.Xbox Now! is trademarked and domain registered. If and when Microsoft wants to use that name they can with very little resistance. Google is not a direct competitor to Xbox. "Bing Now" would be more lawsuit worthy than Xbox Now! Also the "explanation" mark makes it different.

So I had heard something about cross-gen being a big thing and MS is prepping to update 360 to match branding... but is it more than that?
Could we see cross-gen play between 360 and next Xbox?

I don't even like the series, but I would love to see the funky 90s art style of Killer Instinct translated into a brand new next gen game.

If they want to use Xbox Now as the name for the next console, they would have to register it under Nice classification 9 (regarding Europe anyway):
