It is for this same reason that if you download certain music from iTunes or Google Play, or certain movies from Amazon Instant Video, and take your device across a border, the content will be unavailable / removed from your device.

Bullshit. There is no rule that prevents you from downloading accounts to consoles not located in your home country. When I stayed in London for two weeks I downloaded my account to my cousin's UK console.
Oh, bullshit. They made a bunch of games free, presumably by mistake, and a lot of people took advantage of it. It's not theft; it's exploiting an error. Is there anything in their TOS which specifically states that users cannot create accounts in other regions? Or that there will be recourse if they take advantage of MS's mistakes?

You're right, there is no rule preventing youf rom downloading accounts to consoles not located in your home country. There are, however, rules against using region-restricted content in regions which the content is not available.

He had purchased the pass for himself and then recoerved his account on his friends Xbox so the friend could use it as well. I wonder why that hasn't been brought up in this thread cause last week he believed that was the reason he was banned. But he mentioned that he thought it was odd that the Oman account was banned too. But from reading this thread it seems that every account he has accessed on that console has been banned (he said his third account, an American one has not been accessed since the ban). Seems more likely that the console is banned and all accounts associated with it are as well.
The Oman thing is interesting because the games were listed as "Free" when accessed. There was not an option to pay for them through that method.

That would be like buying ten pairs of shoes from a store over a period of time and then finding a pair of shoes behind that store that a staff member had dropped when unloading a truck (horrible comparison I know - it's late I'm tired). Then having the store have him arrested for theft and force him to give all the shoes he had purchased legally back to them.

Oh crap, it appears I've been banned for 'Marketplace Theft' for this, and I haven't stolen games other than using these marketplace glitches (and the one for AC3 a while back). The only other thing even remotely close to that would be from sharing Season Passes with my brothers xbox.
I took it from 3 different consoles to 3 different people. You CAN take it, just follow tutorial/instruction.

Can only speak for Valve, but I can't think of any specific exploits that mirror the Oman stuff. Now Ubisoft seem to have a digital fuckup of some kind every month that nets people free games. More often than not they have sucked it up as "their fault" and moved on.
