That's why at the end of the day, popularity or "character relevance" mean shit. It's all about what Sakurai (and some other powers-there-be) thinks.
I meant in terms of tone.
It's clearly not just a Nintendo crossover anymore.
The guy who created Smash Bros.' vision of the series matters just a little bit more than yours. If Sakurai thinks Snake fits in, then Snake fits in.

Sakurai has a bunch of friends in the industry, but do you think if the creator of some low budget indie game wanted his character in Smash Bros. Sakurai would just go ahead and surrender? Of course not. Kojima's request instigated the process, but it was not the only factor. Solid Snake happens to be one of the most well-known video game characters from one of the most popular video game series.Obviously Sakurai will do what he thinks is best, but I haven't read anything from Sakurai on the subject that suggests he thinks Snake's inclusion is important to the series, he seems to bring up the fact that it was a favor more than anything else. Sakurai is a good friend.

The former is why Wolf got in, The latter is why Certain properties cannot get in.
They do mean things, however people should no go overboard with those concepts. It just creates restrictive conversation.
People are quick to forget that after Melee we got Star Fox Adventures in 2002, Assault in 2005, and Command in 2006. Given the close proximity of those games it made sense that Brawl would get a third Star Fox character, and including Fox's rival was more sensible than adding a third Star Fox team member.
Adding to that, Falco, Ganondorf, and some other characters got a couple of brand new (and/or reanimated) attacks during the jump from Melee to Brawl. All it would take is a new Final Smash and maybe a new special move for Wolf to feel like a completely original character this time around.There's also the fact that Sakurai gave Wolf a moveset that is fairly distinguished from those of Fox and Falco (the A moves are all unique, and while the base of the specials is the same, they still have highly different properties - only exactly same move is the tank final smash really).

I'm not aware of any legal issues regarding Snake.Well this is surprisingly tame for WeekendGAF. A little disappointed, fellows. Also: I think Snake is toast because Legal issues & Sakurai wanting to stay as true to the characters as possible; So no original voice actor = no Snake.

Apparently the original VA quit or was fired, so presumably the voice of snake is the property of Sony and Kojima Productions and the new VA is Kiefer Sutherland, who may or may not agree to voice Snake in another videogame other than what he signed on for, so yeah: legal issues could be a concern and it would be far easier to take a pass, since Sakurai already added two 3rd party characters.

Hayter wasn’t suddenly blacklisted or anything — one of the characters he plays was simply given a new voice actor. Sutherland is very unlikely to voice Snake in any future Metal Gear remakes or spinoffs. I'd imagine any sound clips that have already been recorded would be 100% owned by konami so if they really wanted to avoid paying real-actor dollars for smash sound effects they could probably be completely in the clear re-mixing brawl snake sounds.

And besides, the Japanese voice actor hasnt changed, which is what matters the most here. I doubt Sakurais going to keep a character out of his game because of a localization concern. Thats Nintendo of Americas problem. And with that said, half of the Brawl cast used voice clips from the original N64 game. Nintendo could easily just pay Hayter and re-use Snakes Brawl audio.

I have this strange feeling that despite being a relatively unique character, Wolf felt rushed in non-battle development. His victory stance is pretty much Fox's!

He was one of the last characters to be added in the final stages of development. That's also why they gave him a landmaster (I'd assume at least) and similar special moves.
Out of the characters they added bar Sonic, he seems to be the most developed though - they already had Jigglypuff's moveset done and just had to port it into Brawl, and Toon Link is just a re-skinned Young Link (and Link in general). And even Sonic feels much more rushed than Wolf did.
Out of those 4, his battle animations seem to be the most refined, even though the "details" like victory poses etc. seem more rushed.
Aside from the gun, I don't think any of Wolf's specials should stay as they are. The blaster with built-in melee attack is awesome tho.

Give him fox's blaster range(...and fox get's falco's range and falco get's wolf's range) and all will be right within the smash world.

Snake fit in really well with characters like Link and Captain Falcon in Brawl, so I don't see why he wouldn't work here. He'd just need a softer, bluer costume and maybe a clean-shaven face.On the Snake talk, he might look a bit odd with the new graphical style.
Brawl was somewhat more realistic and less colourful so he could fit in more there, he'd stand out like a sore thumb now.
Not that I want him cut, I love Snake.
I expect only minor changes, perhaps a move or two getting replaced. Given how the Melee clone characters were handled in their transition to Brawl, I would imagine that Sakurai wants to conserve the movesets/playstyles of those characters and only do minor changes.
